My guess is he'd need to sell something to get the funds, and he's saying if he sells something now and later gets off the hook via appeal he would have unnecessarily lost that particular asset.

It's like if you or I had this huge judgment against us and all we had was our house. If we had to sell it to put the money up during the appeal process and eventually the fine was overturned, we'd now be without our house.

Or, he's just trying to weasel out of paying
