Biden's States Right Defense in 2019

Biden gave a States Rights argument to try to defend himself YESTERDAY.

For god's sake it's 2019.

Aren't we, as Democrats, saying a States Rights argument to limit a woman's reproductive rights is WRONG?
As state after state chips away at Roe versus Wade, as states close clinic after clinic, we Democrats have said ENOUGH. States don't have the right to do this.

Are we all supposed to become hypocritical now to defend Biden?

The right not to be discriminated against.

These are NOT issues that States Rights should have control over.

In 1954, in the case of Brown v. Board of Education, the Supreme Court ruled that racial segregation of schools was unconstitutional. However, many neighborhood schools remained segregated due to the demographics of a city or town; children who lived in predominantly black neighborhoods still did not go to the same schools as white children, and vice versa.

In 2007 A Republican controlled, right wing Supreme Court made a narrow 5-4 decision chipping away against this ruling.

"The decision prohibited the use of racial classifications in student assignment plans to maintain racial balance. Whereas the Brown case ruled that racial segregation violated the Constitution, now the use of racial classifications violated the equal protection clause of the 14th Amendment. Writing for the minority, Justice Breyer said the "ruling contradicted previous decisions upholding race-conscious pupil assignments and would hamper local school boards' efforts to prevent 'resegregation' in individual schools"."

In practice, this meant that school districts could continue bussing students on other criteria, such as poverty level. Since segregation along economic lines closely mirrored segregation along racial lines, School districts quickly adjusted their plans and continued to desegregate their schools. Bussing still remains legal.



So, using a narrow ruling by a Republican controlled right wing Supreme Court in 2007 to defend Biden makes him more palatable to Democrats in 2019 how exactly?
