MAIG, Law Enforcement Help Block N.C. Proposal To Eliminate Background Checks

RALEIGH, N.C -- North Carolina mayors and law enforcement tonight helped block a dangerous NRA-backed attack on gun background checks from passing the General Assembly, as lawmakers stripped language from HB 937 that would have repealed the state's handgun permit requirement -- effectively eliminating background checks for private handgun sales.

North Carolina mayors and law enforcement have spoken out in strong opposition to the version of the bill pushed by Washington gun lobbyists, which would have made it easier for criminals, domestic abusers and those with severe mental illnesses to get handguns. 90 percent of North Carolinians support background checks for all gun sales.

The previous version of HB 937, which passed the North Carolina State Senate, would have repealed the state's requirement that all handgun purchases by private sellers undergo a background check -- creating easy access to guns for dangerous people who are currently unable to pass a background check. Empirical evidence shows states that have taken similar measures weakening laws on background checks have seen a spike in violent crime. In states that require background checks for all handgun sales, however, 39 percent fewer law enforcement officials are killed with handguns, and the firearm suicide rate is 49 percent lower.

Currently, because of a dangerous loophole in federal law, criminals can avoid background checks by buying firearms from unlicensed "private sellers" -- often at gun shows or through anonymous online transactions -- who are not required by federal law to conduct them. An estimated 6.6 million guns were transferred in 2012 without a federal background check, accounting for approximately 40 percent of all gun sales in the United States....

Right now you purchase permit lasts for 5 years.

Because the permit functions as a substitute for the instant background check at time of purchase a prohibited person can buy a gun if they had te permit before conviction.

In reality the check is nothing more than a revenue stream because the sheriff must grant purchase unless you are prohibited person. Technically the sheriff can do a mental health check but the state should already be providing that info to NICS.

I'm not really sure if the sheriff based handgun permit process does anything besides keep county sheriffs with a little more control.

Oh and look up the history of this law. It was designed to prevent blacks from buying handguns.

.. you'd rather throw the baby out with the bath water? you'd rather have the nra version where no bg check required for private handgun sales?

Double double talk talk; if you consistently take the nra approach you really belong in Ft Gunsalot. I thought you were quitting the nra? are you still nra member? or just 'torn between two lovers'?

Could you save us the bother & post what you're talking about? the usual protocol? Thanks.
A Jim Crow law eh? yeah it certainly could prevent blacks from buying handguns, as well as whites, hispanics, asians.

should have a background check done. There should be no reason, other than maybe family member to family member, that a background check isn't done.

But I'd still like to see some control to make sure a disqualified individual doesn't inherit an arsenal of weapons.

and maybe a background check would be the only way to insure that a disqualified individual doesn't inherit those weapons.

The bad news is the legislature approved concealed carry in bars, restaurants that serve alcohol, greenways, and PLAYGROUNDS.

There's plenty of cray cray in the NC legislature!
