It is not a part of any branch of the US government and is not bound by the US Constitution. If the leadership of the Democratic Party prefers one candidate over another, why is it not free to promote that candidate by any lawful means available to it? I fail to see the problem.

Article 5, Section 4 of the party charter and bylaws:
"In the conduct and management of the affairs and procedures of the Democratic National Committee, particularly as they apply to the preparation and conduct of the Presidential nomination process, the Chairperson shall exercise impartiality and evenhandedness as between the Presidential candidates and campaigns. The Chairperson shall be responsible for ensuring that the national officers and staff of the Democratic National Committee maintain impartiality and evenhandedness during the Democratic Party Presidential nominating process."

This would not be a problem for many private clubs. But in this case many people join in the primary contest investing things of value, including time and money with the understanding that the contest will be conducted in good faith and that the DNC and the Chair aren't working to bias the odds of winning toward any participant.
Millions of dollars and thousands of hours were invested in good faith, in what no longer looks impartial or even-handed And that's the reason there is a class action lawsuit filed seeking compensation for the loss of those things of value.

(24,396 posts)SCOTUS ruled long ago that political parties can pretty much do whatever they like. Their internal rules have no more force in law than would rules adopted in a sandlot baseball game.
