Experts: "Uphill battle" to push a perjury charge on Hillary Clinton.

During a lengthy House committee hearing Thursday, Rep. Jason Chaffetz, R-Utah, called for the FBI to investigate whether Hillary Clinton lied about her private email servers while under oath in congressional testimony last October.

Government lawyers and experts in perjury cases said such a prosecution would be an uphill battle.

“The bottom line is that it will be an uphill fight if they try it,” Robert Cattanach, a former Justice Department lawyer, told Yahoo News.

The perjury statutes available to prosecutors would require them to prove Clinton made “materially false, fictitious or fraudulent” statements to Congress last October. Generally prosecutors only go through with these cases when they can prove the person intended to mislead on a material, or important, point.

“These are generally pretty hard cases to successfully prosecute,” said Lee Dunst, a lawyer at Gibson, Dunn & Crtucher and a former assistant U.S. attorney for the Eastern District of New York. “If they made a mistake or if they had bad memory, that’s not enough to mean that somebody should be convicted of perjury. You have to show that they actually knew that what they were saying was false.”

My understanding was that Mrs. Clinton was not under oath for the interview, so I'm fairly certain perjury would not apply (not a lawyer over here). That said, I do believe lying to the FBI is a crime. That's what got Martha Stewart, right? But the idea that the Obama Administration would pursue anything like this seems like fantasy.

The Repubs are focused on an enchange about the discrepancy of 15 emails between her and Blumenthal. She said she turned over ALL her emails.

That's their basis for perjury.

If the Congress refers her testimony to the FBI to have them investigate it, the FBI has no other choice but to investigate it which means the Republicans can then say, "we have a candidate for the presidency under FBI investigation".

And really, they would have pulled similar shit regardless of the nominee. They only get more and more odious in their nasty political cheap shots because they've got nothing else.
