If Scott Walker were to resign, then what happens according to Wisconsin law?

Last edited Thu Mar 15, 2012, 12:29 AM - Edit history (1)

Does their law say a new Governor is appointed or would they have to have a special election?

Anyone know what the law there says?

Edited to add UPDATE below

2. Ed Schultz was discussing it was a possibility that he 'could' resign before the recall election.

Ed's guest said that Walker's ego is too big and he thought that Walker wouldn't.
But I was wondering what would happen if he did,
on the Ed Show they didn't say anything about what would happen next.

seeing if the media will pick-up on the speculation...make it water cooler chatter.. This just widdles away at Walker 3-legged stool...which is about to loose a leg.

4. The Lieutenant Governor would succeed.

That is Rebecca Kleefisch. She is currently under recall challenge as Lt. Gov. I think if she became Gov by succession, she would escape the current recall.

She's crazier than all of them. She's the one that rallied against gay unions and said some really vile things. She's a female Santorium - she said gay marriage would lead to marrying dogs or would be the same as marrying a table.

However, even if she were to succeed to the Governorship, there are 4 Senate seats up for recall, any one of which would give us control of the Senate. I think the Fall elections may sweep out a lot of Republican Freshmen from the Assembly too, so a Kleefisch 2013 would be mitigated by the regaining of the Legislature.

so I doubt she will get the job as Governor if Walker resigns.

9. I would argue that since the dates have been set for the recall.

The scenario won't wash. At best, Kleekerfishstick becomes acting Governor until the election is held. Now if by chance Walker wins the recall and he has resigned that might something else to digest.

He's in a much better position to fight off his investigations from the Governor's Mansion.

13. Under Wisconsin law once the signatures are verified there HAS to be a recall election

It doesn't matter if the person being recalled resigns. There's still an election for whoever replaced to get recalled, or in the legislature's case it's an open seat until the recall election.

Wisconsin can't go a few months without a governor, that would just be nuts.
