Whoever, being a candidate, directly or indirectly promises or pledges the appointment, or the use of his influence or support for the appointment of any person to any public or private position or employment, for the purpose of procuring support in his candidacy shall be fined under this title or imprisoned not more than one year, or both; and if the violation was willful, shall be fined under this title or imprisoned not more than two years, or both.

Obviously, everyone involved denies it ever happens.

(11,605 posts)Because regardless of whether he has been as progressive as we want, President Obama is not corrupt and unlike many politicians, he has never given any reason for us to think he sees himself as being above the law. Thus I simply cannot believe he would have offered the position as a bribe, and there is simply no evidence of it because it didn't happen.
I recall reading that Hillary was actually a bit reluctant to accept the position when he offered it in November 2008 after the election. Remember she made that trip to Chicago that she said was for personal reasons but turned out to be to meet with Obama about the possibility of being appointed SOS? If her nomination had been set in stone 6 months earlier, why would she have made that trip?

(45,851 posts)Obama decided the convenience of having Clinton step aside was worth the possible blowback from her stint at State, it's a calculation he made "Just how bad can she be anyway? She has to have smartened up some since the Iraq pratfall" and it's on him.

(11,605 posts)I have seen NO EVIDENCE whatsoever that Obama offered Hillary the Secretary of State position prior to getting elected in exchange for her endorsement, yet I see that meme casually repeated everywhere here. Unless it's all lies, this article I dug up from November 2008 makes it pretty clear that the negotiations regarding her nomination occurred AFTER the 2008 election, and in fact, she was initially reluctant to accept the position.
Think about this: as another poster pointed out, it would have arguably been illegal for him to offer it to her in exchange for her support prior to being elected. If there was one iota of evidence that that's what happened, don't you think Republicans would have pounced on it?

Hillary is the epitome of doubling down on that legacy.
It works out just fine for both of them and just fine for all their money men and sycophants.

If he lets it go forward and allows the full extent of the law to prevail, then he has made it HER problem and not his. She made mistakes, let her pay for them however it turns out.
Simple as that.
