Not true. (It's funny to me to see added emotions like "happily" -- as though she's a cartoon like Cruella DeVille or the classic Evil Stepmother.)

There is no way Congress will pass federal legalization anytime soon. States need to regulate it as they do alcohol, and nobody wants to under-regulate and be blamed when suits crop up about feels of intoxication for safe driving, testing measures, sale and purchase, arguments about whether it's a "gateway" drug, etc.

You change the schedule of the drug, its no longer controlled. Congress no longer matters, because there is no prohibition at lower schedules.

§ 811. Authority and criteria for classification of substances.

(a) Rules and regulations of Attorney General; hearing
The Attorney General shall apply the provisions of this subchapter to the controlled substances listed in the schedules established by section 812 of this title and to any other drug or other substance added to such schedules under this subchapter. Except as provided in subsections (d) and (e) of this section, the Attorney General may by rule -

(1) add to such a schedule or transfer between such schedules any drug or other substance if he -
(A) finds that such drug or other substance has a potential for abuse, and
(B) makes with respect to such drug or other substance the findings prescribed by subsection (b) of section 812 of this title for the schedule in which such drug is to be placed; or
(2) remove any drug or other substance from the schedules if he finds that the drug or other substance does not meet the requirements for inclusion in any schedule.
Rules of the Attorney General under this subsection shall be made on the record after opportunity for a hearing pursuant to the rulemaking procedures prescribed by subchapter II of chapter 5 of title 5. Proceedings for the issuance, amendment, or repeal of such rules may be initiated by the Attorney General (1) on his own motion, (2) at the request of the Secretary, or (3) on the petition of any interested party.

My law degree has been instructive in teaching me how the office of the Attorney General works. It's also taught me how to read a law, rule, regulation, and decision or two.

I would like you to show me precisely how the Executive orders the Attorney General to do anything. Then tell us how the President orders the FDA into schedule and rule changes. You might wish to review Watergate in your defense of rule by Presidential fiat.

Second, you might wish to review what a "finding" is, vis--a-vis federal rule changes. For that, HRC is correct.....you actually do need more research for the rule to pass first Congressional, then SCOTUS muster. EOs actually need to be able to do that, too.

The fact is that until the pot lobby gets off its ass and works to make substantive legislation, federal legalization is dead in the fucking water.

Why make issues about who "wants" what?

We don't know what they "want."

Clinton proposes feds looking at states that have legalized/decriminalized and go from there. (Guess what -- there is no realistic chance for any fed law beyond that right now. None at all.)

Bernie can propose legalizing it, but that doesn't make it any more likely to pass. In fact, it makes it LESS likely to pass, because it makes it less likely he could win a general election.

Anyway, maybe Snoop will prod her to display some real leadership on the topic of cannabis, because changing to schedule II and verbally promising not to upset the apple cart on state medical and recreational reform is at best the bare minimum on the issue.

Her stated position is preferable to the positions of those who want wholesale roundups of medical and recreational marijuana users- Chris Christie and Debbie Wasserman Schultz being the main ones remaining- however, a move from I to II does NOT reconcile the conflict between federal and state law.

does anyone honestly get swayed to vote one way or the other by what some celebrity says or thinks? I don't think I've ever cared one iota about that, whether said celebrity was backing the same person I was backing or not. Snoop Dogg could be voting for an old spare tire and I wouldn't give a shit either way.
