This challenge doesn't deserve to be laughed at, and she's going to let the five Conservatives hand the election to Romney.

(42,760 posts)For example, its safe to say that you aren't aware that if Justice Kagan turned down the stay request, Husted could go to any justice he wants to renew his request for a stay. Any. Justice. As in, Justice Scalia or Thomas. For that reason, its quite common for a single justice to refer a stay request to the entire court to cut to the chase and because institutionally, the court doesn't like to grant stays on a 5-4 vote, whereas a grant by a single justice doesn't show the split in the court.
Could the court grant the stay? Yes. Do I think they will? No. Am I certain? No. But Kagan denying the stay wouldn't appreciably change the situation.

(8,377 posts)Early voting is OK if you are of a special class (military and families) but not for others not in that class.
If I were Roberts, I'd punt this thing.

Kagen is one of the best, EVER. Whatever she does, I back her 100% unconditionally.
