It can, occasionally, prosecute for a violation of civil rights, but such cases are rarely brought, not only because of a lack of resources (there's no way that DOJ can go around the country prosecuting every police brutality case) but because the standard is so limited, such cases are difficult to bring and even more difficult to win.
