Related: About this forumUS Marshals arresting people for not paying federal student loans
Seven US Marshals with automatic weapons arrested a man, putting him in shackles! for an outstanding $1500 federal student loan debt. I'm wondering if the costs of the arrest and paperwork exceeds the original $1500?!
Bernie Sanders, as President, would never take these actions. He's consistent on the topic of student loan debt and tuition free public college so these kinds of arrests never happen.
Paul Aker says he was arrested at his home last week for a $1500 federal student loan he received in 1987.
He says seven deputy US Marshals showed up at his home with guns and took him to federal court where he had to sign a payment plan for the 29-year-old school loan.
Snip
One reliable source in the US Marshalls says Aker isn't the first and won't be the last
Mods I believe the issue of student loan debt belongs in GDP and that this was a federal action meaning it's highly topical for both candidates

(39,171 posts)one of their fundamental jobs is executing all lawful writs, processes, and orders issued by the federal courts. The President is not going to start micromanaging the courts.

(26,337 posts)I was thinking about here in Cook County where the sherriff refused to foreclose homes because the banks were playing fast and loose with paperwork.
hack89
(39,171 posts)it would set off a firestorm he wouldn't need. The president can't be seen as micromanaging the court system.

Madame President, not so much imo

(26,337 posts)The new(ish) twist here is the government is using private debt collectors for student loans.
The debt collectors are getting more aggressive in all collections. In the old days, they would get a judgment and plop it on your credit report to haunt you until, it goes away, or you try to buy a house etc.
Now they sue the debtor, the debtor ignores the suit, the collector gets a judgment and THEN the collector sends a server to summons the debtor to court for asset/income discovery. The debtor, thinking it's like old times, ignores that summons too. I mean why not, we don't have debtor's prisons, right? And you can't squeez blood out of a turnip. Nope. The collector presses the court for a contempt of court and sends the sherriff or, in this case, the US Marshals to drag the debtor in to court. Business friendly judges often times make the amount owed the bail and/or make the debtor sign a payment plan. Now defaulting on the payment plan is "contempt of court".
So who needs debtor's prison when we can just call it contempt of court?
The private debt collectors must absolutely loooove this set up. Because, often times, when the debt collection gets this aggressive, the debtor just calls Peter Francis Geracy to stop the collection efforts in its tracks. Can't do that with student loans.
So if you are a debt collector and have two collection files in front of you - one a student loan and the other a credit card - which one do you aggressively work? The student loan, obviously.
Oh yeah, the student loan lenders bought the collection agencies so they collect on the federal guarantee AND collection/attorney fees.

(12,081 posts)student loan lenders and debt collectors and for making college more affordable so that this is less of a problem. Bernie says he would stop the federal government from collecting profit off of federal student loans and would use that to lower interest rates. He would also use a different formula for calculating interest and would allow students to refinance interest. These are all really good first steps along with increasing taxes on the wealthy to make college tuition free.

(9,658 posts)it is just a variation of what the cops were doing in ferguson, isn't it?
overload people with tickets,fines ect
people can't pay but the court orders them to anyway
then they go to jail for contempt
sad state of affairs
