Why is this woman laughing? Legalizing recreational marijuana did better at the ballot box than she did.




Nothing against Circuit Judge Christina Klinger for doing her job. In her ruling yesterday, Klinger said that South Dakota’s Amendment A legalizing recreational marijuana, which passed last November with a solid 54% majority, didn’t follow guidelines requiring just one subject for proposed constitutional amendments. Amendment A, said the judge, would have created wide ranging changes to state government. Klinger’s decision isn’t a popular one with most South Dakota voters, but process is process, which means the long grind to bring marijuana into the mainstream of South Dakota society has yet to be sanctioned.

Pending an appeal, the amendment, set to become operational on July 1, is now on hold.

The amendment was challenged by two of the state’s top law enforcement officials, Highway Patrol Superintendent Rick Miller and Pennington (think Rapid City) County Sheriff Kevin Thom.

The lawsuit has the full support of Gov. Kristi Noem (seen above in an AP image taken by Briana Sanchez and published in Politico), who, despite her repeated claims that she trusts South Dakotans to make the right decisions about themselves, arbitrarily, capriciously, and cavalierly declared that legalizing marijuana is “the wrong choice.”
