Boeing, Lockheed will not take stealth bomber protest to courts

The Boeing Co. (NYSE: BA) said Friday it won't pursue any further action to challenge the U.S. Air Force's award of the stealth bomber program to Northrop Grumman Corp. (NYSE: NOC).

This means Falls Church, Va.-based Northrop has secured the $80 billion program and has endured all attempts from competitors wrestle the contract away from it. Chicago-based Boeing made the announcement the same day that the Air Force unveiled a rendering of the Long-Range Strike Bomber's design, the first revelation on a program that to this point has been kept completely under wraps. It was also the same day the new model was designated the "B-21."

In November, shortly after the award was announced, Boeing filed a protest with the U.S. Government Accountability Office along with its partner Lockheed Martin Corp. (NYSE: LMT), arguing that the decision was "fundamentally flawed." After 100 days of deliberation, the GAO denied Boeing's protest on Feb. 16.

Boeing had yet to exhaust one final option following the loss at the GAO: filing a formal lawsuit with the U.S. Court of Federal Claims, another venue for lodging protests. Friday's announcement means Boeing has conceded in its loss to Northrop.
