Lawyers for a Guantánamo Bay detainee whose weight has dropped to 74lbs (33.4kg) during his long hunger strike argued in US court on Thursday he should be freed for health reasons, and a judge said he may order an independent medical exam.
During a hearing, US district judge Thomas Hogan said he would examine whether he can order the creation of a civilian-military medical commission to examine Tariq Ba Odah, a 36-year-old Yemeni man, under the Geneva Convention governing treatment of prisoners of war.
Its findings could help determine if Ba Odah should be freed.
Lack of an independent examination makes it very difficult for me to conclude that he has to be released for other medical treatment, Hogan said.
Ba Odah, who American officials call a former al-Qaida fighter, has been held at the Guantánamo Bay US naval base in Cuba since February 2002. US intelligence and military officials cleared him for release in 2010 but he is still being held.
