NRA/Daily Caller Gun Giveaway Challenged by Gun Violence Prevention Groups

The Brady Center to Prevent Gun Violence, Coalition to Stop Gun Violence and Law Center to Prevent Gun Violence are urging the California and New York Attorneys General and appropriate law enforcement authorities to investigate unlawful gun distribution by The Daily Caller and the National Rifle Association as part of a weekly semi-automatic handgun giveaway. The giveaway, which has continued despite the death toll from daily gun violence and horrific mass shootings, launched with the threatening tag line: “It’s harder to pay lip service to the Second Amendment when you’re looking through the sights of a loaded gun.”

A letter sent today charges that The Daily Caller and NRA have engaged in an illegal “high capacity 9mm” “gun giveaway” promotion that endangers public safety and violates the civil and criminal laws of California and New York. Each state may impose misdemeanor criminal charges and civil fines and penalties against The Daily Caller and NRA, and require that the NRA return money unlawfully raised as a condition of entry into the giveaway. The Attorneys General of California and New York have been strong supporters of keeping guns out of the hands of dangerous people and enforcing the law to prevent gun violence.

“The decision to bring a gun into the home should be approached with cautious deliberation; with an awareness of the potential risks and dangers to everyone. It should not be trivialized by treating it as a game,” said Dan Gross, president of the Brady Center. “We urge the Attorneys General of California and New York to enforce state laws and make clear that anyone who distributes guns in violation of the law will be stopped.”

but these attorney generals would have no case. One reason is the Gun Control Act of 1968, which says the winner will have to pick up his gun from a FFL holder, where all federal and state laws would be followed.

Under the Bill of Rights the media has the freedom to publish their views but this freedom should require the responsibility to report and to editorialize in a fair and honest manner.

Through the years the media has stated that allowing "shall issue" concealed carry would result in a return to the Wild West with shootouts occurring at every intersection and on Main Street at high noon in EVERY state that was considering the passage of this law. I feared that this would happen in Florida when "shall issue" passed in 1987 but the law didn't lead to the blood in the streets that was predicted. After ten or fifteen states had passed "shall issue" an honest media would have mentioned that this law had led to no significant problems but instead they choose to ignore the statistics and continue the Brady Campaign propaganda in every state that was considering allowing concealed carry.

Despite all their efforts the media failed to discourage the spread of legal concealed carry across our nation and their work to support the Brady Campaign propaganda is largely responsible for the distrust the American public have in media honesty.

Owning a firearm requires venomous responsibility. So those running a newspaper or media outlet. Gun owners are largely responsible but I feel the media has largely failed on the gun control issue.

While I can't agree about "requiring responsibility," It is obvious that MSM has taken up the battle in lieu of ANY meaningful activist or grass-roots organization (which are necessary to declare oneself as a "movement&quot . The new media seems perplexed that there is a "silence" on the issue of gun-control. They shouldn't be: MSM is not the American people, nor does it represent a "movement."

There is no "movement." Only an outlook -- which MSM actively promotes, even as they lose influence overall.

Their technical ignorance is almost embarrassing it is so comical. They apparently have trouble comprehending the rules, if they even bothered to read them.

Eligibility:
This contest is open only to legal residents of the 50 United States where firearms are legally transferable. The winner must currently reside in the US and be 21 years of age or older at the time of entry. Contestants may submit one entry per email address each week for each successive contest.

The winner will be required to have proper identification suitable to receive a firearm in their jurisdiction and will be required to complete an ATF Form #4473 and pass a NICS background check at their local firearms retailer that holds a valid Federal Firearms License. Failure to comply with each of these requirements will result in a forfeiture of the prize. The winner will be responsible for any fees collected by the retailer to perform any background investigation or transfer fees. This offer is void where prohibited by law, and subject to all applicable federal, state and local laws and regulations.


Transfer of Firearm:
The Daily Caller is not responsible for the transfer of the firearm. The firearm will be sent from FMK Firearms to the winner’s designated FFL holder. It is the responsibility of the winner to have the FFL holder fax, email, or otherwise transfer a copy of the FFL to FMK Firearms. FMK firearms will then ship the gun to the FFL holder. The winner is then responsible to complete the transaction with the FFL holder. Instructions will be provided to the winner upon acknowledgement of notification from The Daily Caller.



Daily Caller is following all the applicable laws. Absolutely pathetic that the Brady Campaign is trying to spin this as illegal but then they aren't known for being terribly ethical anyway.

You don't have to pay anything to enter the sweep stakes. There are free e-mail options and Twitter options. The only week where entry required a payment (Week 7) and that was in the form of a discounted NRA membership through a special link. But if you entered during a previous week you still had a chance throughout the duration of the contest. Just another desperate attempt at relevancy by the Brady Campaign.

I'm surprised this contest got by the numerous attorneys that are employed by the NRA. In Minnesota, this is an illegal contest. There is a way to determine whether a contest is legal in Minnesota: prize, chance, and consideration. If all three of those are present, then it is an illegal lottery. In this case the prize is the 9mm handgun, the chance of winning it is self-explanatory, and consideration is the money paid to become and NRA member to get the chance to win. It does not matter if the contestant receives value for the chance to win (ie the NRA membership).

Ok, never mind. I wrote the above post before reading Clames' post. If there are alternate ways to enter the contest without paying anything, then it is not an illegal lottery. I should have known the NRA would not have missed that.
