The 30 year-old Palm Harbor resident was shot and killed during a confrontation with another driver around 2 a.m. March 6 in East Lake's Boot Ranch neighborhood, according to the Pinellas County Sheriff's Office.
The state attorney's office is now investigating the shooting, which a sheriff's detective told Baker's father appeared to be a "stand your ground" case. The controversial Florida law allows people to protect themselves when they have a reasonable fear for their lives.
The man who shot Brandon Baker is a 23 year-old security guard named Seth Browning. Browning was off-duty at the time of the shooting and told detectives he followed Baker to get his license tag information because he was concerned about his driving. Baker, who was unarmed, was shot and killed during the confrontation that happened on a road leading to Baker's apartment. Browning says he fired when Baker allegedly hit him and continued to go after him after he sprayed Baker with mace (read previous coverage about the shooting).
Baker's father, Kevin Lindsay, who lives in Largo, does not see it as a "stand your ground case". He says says his son was on his way home from New Port Richey, where he and his twin brother Chris had picked up Chris' girlfriend Amy from work. Lindsay thinks Browning was the aggressor.

I presume that if there were any specifics besides "skin color of driver" that they would be stated.
Even following while driving is questionable. Forcing the guy out of his car justifies HIM shooting YOU with a stand-your-ground defense.
You just don't, under any circumstances, get to pretend to be a cop when you're not. As a citizen you simply don't have that authority, and it is completely normal for people to reject it and assume you to be a thug.

How do you know that he was pretending to be a cop? Where you there?
Even following while driving is questionable. That doesn't make any sense at all.
Throwing up the race card I see I.E., skin color of driver, It could be that the driver was driving erratically.
What does his being off duty have anything to do with it?

And the police can do... what, exactly... with no identifying information? Following someone is not always, or even usually, illegal. You have to look at intent.

I've done this before. In Florida. Followed a driver who was definitely intoxicated, while calling police on my cell-phone. Gave licence plate #, make/model/color of car, location/direction and followed until police intercepted. Gave my statement to them and went home. They thanked me profusely. Apparently the guy was a frequent flyer.
As a Citizen you don't get the authority or obligations of police, but as a member of society, you have an obligation to help protect that society. Just don't pass the lawful limits in place.

According to investigators, Brandon continued to approach Browning's car. Deputies say Brandon then reached into Browning's vehicle and punched Browning, who in turn pulled out his gun and shot Brandon.
It sounds like Browning did not get out of his car, was facing one aggressive person who was punching him, with a second person joining the attacker. Pretty much the definition of disparity of force SYG or no.
-a couple other factors-
what was the relative size disparity between the parties?
was Browning's vehicle blocked by the other two so he had no option to retreat?
what was the concern about driving? was alcohol involved or were the brothers driving carelessly so as to cause Browning to call a report? I do that whenever I can identify a vehicle that is clearly a danger to other drivers. In the great majority of cases, I will cease following once I have given all important information but a few times it has been so hazardous that I will follow and stay on with 911 until the police arrive.

So what your saying is that the investigators are a bunch of dumbasses who can't tell if the shooter is telling the truth or not? And that they can't analyze a scene and tell what happened? Your hatred of gun owners has really clouded your judgement.
BTW, you don't know what the fuck your talking about, dead men tell no tales? Uh, yes they do. Ever heard of forensics?

Armed individuals would create a "situation".
Use a Second Amendment Solution
and hide behind SYG.

They weren't prepared, they got chewed up and spit out. They got royally used and put up wet. If they had anything, Zimmerman wouldn't have walked.

(17,502 posts)before you can be arrested. It was still investigation, waiting awhile for charges even in murder is not that unusual. How was JEB's SYG different than Illinois passed in 1961?

I'll bite... how many punches/how much physical damage should he have taken before defending himself?
... or is 'hassling' other drivers a capital offense now?

there would be evidence of him being punched, you know, like that pesky little thing called a bruise or cut or whatever. The cops wouldn't just take his word for it.

(502 posts)The cops aren't going to go on just his word, there had to be physical evidence or the other brother confirmed what happened. At this point we just don't know but, hey, facts don't matter to you do they?

In other words, Browning used lethal force only after less than lethal defenses failed.
and I really don't give a rat's ass what Baker's daddy says. I'm sure Teresina Capone thought her son Alphonse was an innocent businessman too.

(158 posts)I am "concerned" with other peoples driving every day but all I DO is avoid their stupidity.
I suspect there is more to the story than what the shooter is admitting.
