Control advocates in NY, still flush with the SAFE act victory...

Sen. Tony Avella vocal gun control proponent, having succeeded with the SAFE Act, has moved on in his holy pursuit of control, as he continues to preach the doctrine of weapon control...

Now he has moved on to any knife with a blade more than 4 inches (including kitchen knives)...

As many have correctly and repeatedly pointed out, it is ALL, about control...

Anyone with a knife longer than 4 inches – even a simple kitchen knife – would be in violation of an administrative code, and would face up to 15 days in jail and a $300 fine.

A machete could lead to a year in jail.


Not a surprise really, most gun control advocates obsess about controlling the public, Remember Bloomberg's jihadi on soda..

criminal possession of a deadly weapon 265.01-2 and its over 4 inches & its not used for hunting or fishing.

The hearing for both at the 2nd Circuit Court of Appeals was held on 12/9 and the 2nd Circuit Court of Appeals usually comes back with a ruling between 3-6 months after the hearing.

From people who were present at the hearing, they said the attorney's for NY & CT did not do very well in presenting their oral case and a key witness for NY & CT admitted that the AWB was unlikely to work and that banning so called military features would no impact.

Regardless of the ruling expect the losing side to appeal and it could go to SCOTUS as soon as this fall

Link to legislation. In effect, it alters the penal code to read:

Section 1. Subdivision 12 of section 10.00 of the penal law, as
amended by chapter 257 of the laws of 2008, is amended to read as
follows:
12. "Deadly weapon" means any loaded weapon from which a shot, readily
capable of producing death or other serious physical injury, may be
discharged, or a switchblade knife, gravity knife, pilum ballistic
knife, metal knuckle knife, dagger, MACHETE, billy, blackjack, plastic
knuckles, or metal knuckles.

According to S 265.01 of the NY Penal Code, simple possession of such a deadly weapon is a Class A misdemeanor. The "exemptions" section of the code (S 265.20) does not have any provision to allow you to use a machete in your back yard for clearing brush...

worse yet add it to the list of things that i can not offer a resonable counter to my republican friends.
