A Sharonville abortion clinic must close its doors, a Hamilton County magistrate said Monday, vowing to rescind a judge's decision to let the clinic stay open.

The magistrate's decision, expected July 10, can't overrule the judge without his approval, however, and so the fate of the clinic will rest once again with the judge who issued the stay: Hamilton County Common Pleas Judge Jerome Metz Jr.

The legal battles of the Women's Med abortion clinic started in January, when the Ohio Department of Health ordered the clinic to close. The clinic had requested -- and was denied -- an exception to a state rule that requires all outpatient surgery centers to have a transfer agreement with a local hospital. The decision put 2.1 million people in Greater Cincinnati closer to losing access to a local abortion clinic...


... The magistrate's ruling marks the latest turn in the abortion clinic's scuffle with the administration of Gov. John Kasich. An Enquirer investigation this winter showed that, starting in 2012, top officials in the health department were involved in the clinic's attempt to renew its license, directing the department's staff not to follow normal practices – such as requesting more information or scheduling an inspection – to review or renew the license....

Which btw is the only one in NC that would possibly meet the "new guidelines" leading to the possible shuttering of all clinics in NC.

I don't get the negative on this. If I was running any kind of clinic, I would want t have the opportunity to have a hospital to take patients that have problems that perhaps we can't handle.

Involve the morning after pill, referrals/check ups and birth control distribution. This is NOT about abortion. It is about MONEY AND POWER. We are just another cash cow to these Asses and they could give a damn about our reproductive health. From their perspective We are just another Poor Misguided player but it's in their comedy of errors.

I know of people dying getting plastic surgery. I wouldn't want to risk any woman's life. If we can get them to a hospital, then let's do it. Why be stubborn and close the clinic down due to some superiority or something. Sometimes maybe the decisions are right. Wouldn't having hospitals available that could save ONE life worth it? Or is the pride more important? This seems common sense to me.

The Mississippi law would require all physicians in health centers that perform more than 10 abortions a year to be certified in obstetrics and gynecology and have admitting privileges at a nearby hospital.

The law was passed in April 2012 but is not currently being implemented while a challenge continues in the courts. A federal judge issued a preliminary injunction in 2013, saying the law was likely unconstitutional because it would close the lone remaining clinic. The state appealed the decision, sending the case to the 5th Circuit.

Jackson Women's Health Organization, the one clinic that offers legal abortions in the state, has two providers, neither of which has admitting privileges. Clinic owner Diane Derzis said the facility sees 2,200 women for abortions each year.

The clinic tried to obtain admitting privileges for the doctors after the law was passed, but no hospital would accept them, according to Derzis. "Weapplied to every hospital—eight to 10 of them," she said. "The Catholic hospital turned us down immediately. The rest took a while, but turned us down without looking at the physicians. They put in writing that they were unable to handle the public press from this; they were upfront about it. It's clear the politics prevailed with this whole thing."

Even if Miller could afford to build or lease ambulatory surgical centers for her rural clinics, her doctors would be unable to get admitting privileges at hospitals in Beaumont and McAllen, she said.

"The hospitals in Beaumont told us verbally that there's no way they'll send us an application because of what we do," Miller said. "And the physicians at the hospital in McAllen were too scared to cosign our application because they were worried about being targeted by the community."

Women in McAllen will now have to travel five hours to San Antonio for an abortion. Because Texas law requires women to wait 24 hours between a consultation with the provider and the procedure, women will have to figure out how to get child care or take time off work while they travel and then wait another full day for an abortion.

"If this isn't undue burden on women's access to abortion, I don't know what is," said Miller, who is waiting for a decision from the federal 5th Circuit Court of Appeals on her challenge to the new requirements.

Louisiana Gov. Bobby Jindal (R) signed into law on Thursday an anti-abortion bill that could shut down four out of the state's five abortion-providing clinics.

The bill, which requires all abortion providers to have admitting privileges at a nearby hospital, is similar to a law that has been shutting down clinics in Texas. Only one of the five clinics in Louisiana currently complies with the new law.

Supporters of the bill say it is intended to protect women who have emergency complications from abortion procedures. But doctors and medical groups, including the American Medical Association and the American College of Obstetricians and Gynecologists, oppose these types of laws, arguing they are not necessary for patient safety. Women who have complications during an abortion can already access care at a local emergency room, and hospitals often turn down abortion providers' applications for admitting privileges for political or financial reasons unrelated to the doctor's safety record and qualifications.

“We all want women to be safe, but this law doesn’t protect women’s health,” said Jennifer Dalven, director of the American Civil Liberties Union Reproductive Freedom Project. “In fact, major medical groups like ACOG and AMA oppose these laws because they actually harm women by preventing them from getting high quality medical care. Given that doctors and medical groups oppose these laws, we have to ask ourselves why some politicians are pushing them?”
