Georgia court dismisses unsolicited 'sexting' case

The US state of Georgia's supreme court has dismissed an obscenity case against a man who sent a woman an unsolicited photo of his tattooed penis in a text message.

The court ruled unanimously that the 1970 law applied only to "tangible" material sent through the post.

Charles Lee Warren faced up to three years in prison.

So it is a problem only if the U.S. mail is involved? I guess the court system could be overrun if it applied to text messages. I have received sexually explicit texts before that were sent to the wrong number. I don't think it's that uncommon. I would hope if someone was repeatedly sending obscene texts they could be charged with harassment.

Even weirder -

According to prosecutors, Mr Warren's penis was tattooed with the phrase, "STRONG E nuf 4 A MAN BUT Made 4 A WOMAN", Reuters reported.


Who would tattoo a deodorant commercial on their penis?!?
