Richland Hills police say a 71-year-old woman committed a hate crime Wednesday night when she choked her son's would-be roommate with her cane.

Wanda Derby faces charges of assault and aggravated assault with a deadly weapon (enhanced as a hate crime), police said. She's also accused of striking the 25-year-old victim's mother as she called 911.

Police arrived at the Ash Park Apartments about 8:30 p.m. Wednesday to find the man with marks and bruises on his throat and torso, police spokesman Tye Bell said.

When speaking to officers, Derby referred to the victim using a gay slur and said he had AIDS and was "going to kill" her son.

The victim told police that Derby struck him several times with her wooden cane and then held him against a wall with the cane across his throat. When his mother tried to intervene and called 911, police say, Derby struck the woman in the face.

Police say Derby's son planned to move in together with the victim, which angered Derby.

Pretty embarrassing for a fit 25 year old male to get his butt handed to him by a 71 year old grandma. I personally hate these kinds of applications of hate crime laws. It was assault, that's it. After that, it's Thought Crime for hurting this kids feelings.

Did I say kid? 25 is a man, or should be anyway.
