EAC issues notice of non compliance for DS200 Optical Scanner

On February 1, 2012, EAC issued a Notice of Non-Compliance to ES&S regarding the DS200 Precinct Count Optical Scanner in the EAC certified Unity 3.2.0.0 voting system. The three substantiated anomalies discussed in the Notice of Non-Compliance are:

Intermittent screen freezes, system lockups and shutdowns that prevents the voting system from operating in the manner in which it was designed.
Failure to log all normal and abnormal voting system events.
Skewing of the ballot resulting in a negative effect on system accuracy.
The manufacturer can choose to remedy the three substantiated allegations and provide those remedies to jurisdictions currently using the EAC certified Unity 3.2.0.0 system. If ES&S chooses not to remedy the substantiated allegations, EAC will have to decertify the Unity 3.2.0.0 system.

In order to bring the voting system into compliance, the cause(s) of the anomalies must be eliminated at the root cause level and a modification to the Unity 3.2.0.0 voting system must be submitted to EAC and a VSTL via the process outlined in Section 7.6.2 of the Voting System Testing and Certification Manual. If ES&S chooses to remedy the anomalies, they must provide EAC with a request to cure the system by February 29, 2012.

As mentioned in the Formal Investigation Report, EAC intends to conduct a manufacturing site review focusing on quality control and assurance. This review has not been scheduled at this time.
