The Trump abortion 'gag rule' can take effect in Washington, appellate court rules
The Trump administration's controversial "gag rule," which would forbid abortion referrals by federally supported family planning clinics, can take effect, a three-judge panel of the U.S. 9th Circuit Court of Appeals ruled Thursday.
The judges, all Republican appointees, threw out district court injunctions in Washington, Oregon and California that had blocked the rule.
"Unless overturned, this flawed decision will hurt Washington women, especially low income women in rural Washington: We will swiftly challenge this decision -- I expect this decision will be overturned," Attorney General Bob Ferguson said in a statement.
It is the first setback for Ferguson after 22 victories in the AG's multi-front legal battles against the Trump administration. He had won, in Eastern Washington, the nation's first injunction against the "gag rule" taking effect.
