It wasn't until the end of their July 3 meeting that county supervisors addressed what Vice Chairman Shawn Williams called “the elephant in the room”: providing a public response to the June 24 report of the special grand jury investigating the conduct of Supervisor Eugene Delgaudio (R-Sterling).

Wednesday’s meeting urged the board—and Delgaudio—to take action.

Steven Hall said he looks at the public facilities available to residents of other areas
of the county he wonders why the long-planned Sterling Library expansion remains stalled.
“When are you going to do something for us? When are you going to do something for our
town? I’ve had it. I think you should resign,” he said to Delgaudio.

Al Nevarez, who ran against Delgaudio as a Democratic candidate and spearheaded a recall
petition drive, spurred a shouting protest from Delgaudio when he accused the supervisor
of corruption and being a “criminal.” ... “You must not just have any shame in your body whatsoever. It’s embarrassing. We’re tired of it,” Nevarez said. “I just wanted to make it clear that you did something wrong and everyone in this county knows you did something wrong.”

business meeting on July 3. It's 3 hours and 56 minutes long. I believe that the microphone is turned over for public comment at around 2:12 into the video. Al Nevarez shows up at about 2:27:40, and that's when the fireworks begin. Delgaudio speaks at about 2:35, demonstrating Samuel Johnson's pronouncement that "patriotism is the last refuge of a scoundrel."

Seven Loudoun residents, most well-known Democrats, unloaded rounds of verbal assaults on county Supervisor Eugene Delgaudio during Wednesday's Board of Supervisors meeting, the first full-board gathering since a special grand jury investigating Delgaudio released its report June 24.

The speakers who derided Delgaudio (R-Sterling) noted the grand jury's report, which while not calling for an indictment, spelled out evidence that Delgaudio likely conducted personal fundraising using public resources. The report explained that there isn't a statute in place to prosecute these particular circumstances.

The most contentious moment of the meeting came when Delgaudio's 2011 election challenger, Al Nevarez, stood several yards in front of the Sterling supervisor and called him a criminal.

“You must just not have any shame in your body whatsoever. It's embarrassing. We're tired
of it,” Nevarez said to Delgaudio. “ … At some point you have to feel it in your body that what you do is wrong. You dis-serve our government. You dis-serve your country. Take
that flag [lapel pin] off, you don't deserve to where it. You're a criminal.”

Delgaudio has been a political trickster since 1987 at the helm of Public Advocate. He wore a black and white striped convict’s uniform that year on Capitol Hill, waved placards at passing Senators, insisted U.S. Supreme Court nominee, Robert Bork, was too tough on crime for criminals to support him, expecting this opaque irony would somehow convince Senators to vote for his confirmation. They didn’t. Fifty-eight Senators said “No.”

Delgaudio’s political theater since has only confirmed his rudeness and bigotry, particularly toward gays. ... Not too long ago, Public Advocate allegedly hijacked a copyrighted marriage photo of a gay couple, altered it and published it in a political campaign attack on an unrelated Colorado state senator who supported civil unions.

In order to support his questionable political antics, Delgaudio raises money for Public Advocate, $1.1 million in 2011 (and he paid himself $133,000 that year).

It was little surprise therefore that the grand jury focused on Delgaudio’s fundraising.

Within the past five days, Loudoun County Supervisor Eugene Delgaudio has compared a former opponent to Adolf Hitler and called board Chairman Scott York a “hypocritical bully."

On the July 4 holiday, Delgaudio (R-Sterling) provided email commentary on the previous night's board meeting during which several speakers attacked the Sterling supervisor for his alleged use of county resources for political fundraising. ... In the email, Delgaudio says his former opponent, Al Nevarez, “is like Adolph [sic] Hitler in WWII or similar to Saddam Hussein in the Gulf War claiming the Coalition Forces were not fighting for freedom. Extremely twisted.”

Nevarez was one of seven speakers July 3 who specifically addressed Delgaudio during the board's public comment. Nevarez, who lost to Delgaudio in the 2011 election, called the supervisor a “criminal.” ... “You must just not have any shame in your body whatsoever,” Nevarez said to Delgaudio, a recent subject of a special grand jury investigation. “It's embarrassing. We're tired of it … At some point you have to feel it in your body that what you do is wrong. You dis-serve our government. You dis-serve your country. Take that flag [lapel pin] off, you don't deserve to where it. You're a criminal.”

Days later, on July 7, Delgaudio touched on state Del. Tim Hugo's comments about York (R-At Large). Hugo, also a Republican, said York should resign from the Northern Virginia Transportation Authority because of comments York made -- via his legislative aide -- to Leesburg Town Council. ... Delgaudio wrote: “York is hypocritical bully who opposes commuter lot for poor people while supporting Metro and giant truck highways for air cargo." ... York on Tuesday said he doesn't need to respond to “the clown's comments.”

Loudoun County Supervisor Eugene Delgaudio (R-Sterling) today initiated legal action against the governing body on which he serves by filing a complaint in the Loudoun County Circuit Court.

The complaint, which lists Delgaudio as the plaintiff and the Loudoun Board of Supervisors as the defendant, requests the local court issue a declaratory judgment and impose an injunction against the Board of Supervisors.

The attorney for Supervisor Eugene Delgaudio (R-Sterling) Monday filed a petition seeking a court injunction to block the full Board of Supervisors from voting to take disciplinary action against him during Wednesday’s meeting.

A Circuit Court hearing before Judge Thomas D. Horne has been scheduled for 8:30 a.m. Wednesday. The board meeting is scheduled to start at 4 p.m.

Perennially ethically challenged Loudoun Republican Supervisor Eugene Delgaudio (R-Sterling) is never one to miss a chance to stage a bit of political theater, but this time he may even have outdone himself: facing a possible vote of censure at tomorrow night’s Board of Supervisors for unethical conduct that even his fellow GOP supervisors cannot completely ignore, Delgaudio last night filed suit in Loudoun Circuit Court seeking a temporary injunction to block the Board from taking up the little matter of his misuse of office, accepting $5,000 in illegal cash campaign contributions from a local pastor, abuse of his staff, and neglect of basic duties of office.

So why is Eugene engaging in this apparently futile and hopeless stunt? The answer, as always, is that it is pure political theater. Delgaudio is hoping to build a whiny case in the court of public opinion (where he has done so well in the past) that poor, persecuted Eugene is being unfairly picked on and denied his rights. His motion for an injunction demands, among other things, that before the Board takes any vote to censure him, it must present him with a written list of formal charges, provide advance notice of any hearings, allow him to cross-examine witnesses, and grant him the power to subpoena his own witnesses — all specious attempts to suggest that disciplining a member of a legislative body for misconduct is somehow akin to a court proceeding where the defendant enjoys the presumption of innocence and all the other trappings of a trial. Of course it is no such thing.

As we said before, it’s certainly cheap entertainment! Might be worth staying up late Wednesday night for Item 18 on the Board’s agenda to see if Eugene goes completely postal — or, possibly even more entertaining, if he manages to provoke Chairman Scott York (R) into one of his legendary anger-management failures.

Loudoun Circuit Court Judge Thomas D. Horne this morning denied a petition filed by the attorney for Supervisor Eugene Delgaudio (R) to grant an injunction that would prevent the Board of Supervisors from voting tonight to impose disciplinary penalties on the four-term Sterling District representative.

Citing the federal appeals court ruling in a similar Loudoun County case, Horne said the Board of Supervisors holds clear legislative authority to discipline its members and having a judge dictate that process would tread on the constitutional separation of powers.

The ruling sets up another round of arguments this afternoon. The board is scheduled to convene its regular business meeting at 4 p.m. A discussion of how supervisors should react to the findings of a special grand jury that investigated allegations of misconduct by Delgaudio is the final item on the meeting agenda.

County Attorney John R. Roberts argued the petition failed to meet the criteria for granting an injunction and stated that many of the objections laid out in the pleadings were merely speculative. He also said the courts should have no role in controlling the board’s legislative process by directing supervisors how to handle their review of the concerns about Delgaudio’s conduct.

To the surprise of legal scholars nowhere, Loudoun circuit judge Thomas D. Horne this morning denied the petition by Very Strange Loudoun Republican Supervisor Eugene Delgaudio (R-Sterling), who was seeking a court order to prevent his fellow members of the all-Republican Loudoun Board of Supervisors from voting tonight on a possible punishment of Delgaudio for his multiple ethical violations.

The very enjoyable irony in all of these latest developments is that the sole obstacle to sweeping Delgaudio under the rug has been Delgaudio himself. His frivolous lawsuit is surely just the beginning of what we can only hope will be an ongoing spectacle that will keep him and the Board’s larger ethical problems in the spotlight for months to come. Delgaudio’s 15-year-old lawyer, Charlie King, in court this morning hinted he was prepared to bring forth evidence that other GOP supervisors had also accepted illegal cash campaign contributions. Hell hath no fury like a wacko Loudoun Republican supervisor scorned!

They did a fine job of burying it on the Board of Supervisors website, but at last Chairman Scott York (R-At Large) and Vice Chairman Shawn Williams (R-Broad Run) have itemized the specific acts by ethically challenged fellow supervisor Eugene Delgaudio (R-Sterling) that they plan to bring before the Board for possible disciplinary action tonight.

Here are the five charges, laid out in a memo sent by York and Williams to Delgaudio on Monday, and which are further substantiated in detail in a memo from county attorney Jack Roberts to the Board that summarizes the grand jury’s findings:

1. Misusing public assets for Public Advocate business.

2. Misusing county employee(s) by having them help with political fundraising.

3. Misusing county employee(s) by having them going door to door to drop self promoting fliers. The Chairman’s aide received a call from a Sterling resident who claimed one of your aides knocked on her door and when she told the aide that he was not allowed to be soliciting, according to the resident, your aide replied by saying, “don’t be surprised if you find your car windows spidered.” A term used to indicate a shattering of the windows. This resident filed a police report, but no charges were brought forth.

4. Verbally abusing members of the public.

5. Verbally abusing your staff aide. There were several incidents when Donna Mateer came to several of the staff including to one of Chairman York’s aides that she was being berated by you. Specifically she told several staff aides that you called her “stupid” and told her not to attend the staff aides meetings because she was too “stupid”. Additionally she told at least two of the staff aides that you called her a f***ing b**ch.
