Construction continues, VDOT sues as Ashburn man holds on to his home

After months of waking up to bulldozers and the sound of drilling in his backyard, Ashburn resident Shawn Pahlavani has recently learned that the fate of his property which is being taken by the state through eminent domain is just about finalized.
The Virginia Department of Transportation filed a lawsuit Aug. 9 against Pahlavani for the title of his property after the state invoked eminent domain to connect and extend Russell Branch Parkway a roadway local officials say is critical to reducing congestion, but one Pahlavani argues is being built to benefit the future 6.7 million-square-foot $2 billion Kincora development neighboring his home.
A Loudoun County Circuit Court judge in March determined Pahlavanis dispute with VDOT would go to trial. ... But with no trial date in sight a day Pahlavanis attorney predicts might not even happen for a year all the Ashburn resident can do is wait.
I really wanted to have a hearing before all of this, before the road was built for the judge or the justice system to decide for our life, our property, not VDOT or Kincora or the Loudoun County Board of Supervisors, Pahlavani said. This is not fair. This is not right. Of course they are going to look after the big developer.
