The father of an 18-year-old man who was killed last year at Ashburn's Luck Stone Quarry when he was buried under 522 tons of debris is suing the corporations responsible for manufacturing and installing a hopper that malfunctioned on a sand plant fines silo that collapsed.

Brian C. Potter of Front Royal filed suit July 25 against Tank Connection, CSE Inc. and Fisher-Klosterman Inc., saying the defendants should have known about the hopper's dangerous condition that failed as his son entered the silo to operate an air flow system.

Daniel Porter died Aug. 3, 2015, after he was directed to remove material from the sand plant fines silo and dump the material at an on-site fines storage. ... The silo collapsed when the hopper inside it ruptured, allowing the material to escape. ... Daniel Porter's body was found in the wreckage at 11:15 a.m. the following day.

His father is seeking damages for the mental anguish, among others, as well as compensation for all funeral and burial expenses. ... In January, the U.S. Department of Labor Mine Safety and Health Administration said Porter's death was due to Luck Stone's failure to ensure proper safety inspections were completed.
