Ken Paxton will not be forced to testify during his Senate impeachment trial, Lt. Gov. Dan Patrick ruled Tuesday morning.
Patrick, who is acting as the judge in the impeachment trial, said although the case is a political process, Paxton still can't be forced to testify against himself because the structure of the proceeding is based on that of a criminal trial. This is consistent with the Constitution, Patrick said.
The motion was among the last of a batch that set the ground rules for the trial.
