Texas ethics panel studies donors financing Attorney General Ken Paxton's defense

HOUSTON — The Texas Ethics Commission is suggesting in a draft opinion that Attorney General Ken Paxton could use out-of-state donors to finance his defense in a felony securities fraud case.

The draft opinion was circulated ahead of a Monday commission meeting, the Houston Chronicle reported Sunday.

The opinion says a state employee could accept a donor's help "if the donor's only connection with the jurisdiction of the public servant ... is the act of giving the benefit."

While the ethics commission did not identify the person who requested the opinion, the way the commission addressed the potential issue indicates it may have been directed toward Paxton. State law prohibits the attorney general's office from receiving any benefit from someone the attorney general could regulate in some way.
