DALLAS More than a month after the U.S. Supreme Court legalized same sex marriage, Texas is not fully recognizing the landmark ruling and refuses to issue death certificates that recognize same-sex marriages.
"It looks to me like we're headed back to federal court," said widower John Stone-Hoskins.
He plans to file a lawsuit against the state on Monday, asking a judge to force Texas to let him change his late spouse's death certificate to reflect their marriage.
"We want to make sure in his lifetime his marriage to James [Stone] is recognized. He deserves that much," said Neel Lane, attorney with Akin Gump, LLP.

Like this: My son's friend's grandmother died, and he asked me what I'd charge the family for a casket spray. I said $150, for a big one made of roses. (Retail: $450) They wanted blue, and I went to the wholesalers and took photos to make a slide show of blue and bluish flowers so that they could pick what they liked. (Few flowers are truly blue.) Offended that I wouldn't do it for free, they went to another florist and paid $450, and the only thing blue on the spray was a ribbon.
If you understand that attitude, you understand Texas.
I don't, but I sure recognize it when I see it.
