Update: ‘A historic day for Hood County’ after lawsuit leads to marriage license

Update at 4:08 p.m.: At 3:30 p.m. today, Joe Stapleton and Jim Cato walked into the Hood County Clerk’s Office to pick up their marriage license — 10 days after the U.S. Supreme Court made it legal for same-sex couples to marry in all 50 states, and about 12 hours hours after the couple sued Hood County Clerk Katie Lang to get their license.

“We’ve had this conversation for 27 years, and it always ended in the same thing: ‘Never in our lifetime, never,’” said Stapleton after they paid for and picked up their license. “This is incredible. I can’t believe this is happening.”

“It’s an incredible day,” said Cato. “It’s a historic day for Hood County.”

But the couple is not going to drop the lawsuit: Attorney Jan Soifer is seeking a permanent injunction that prohibits Hood County from denying other same-sex couples from immediately obtaining a license, and she wants Katie Lang’s office to cover attorney’s fees.
