Democratic AG candidate questions decision to appeal gay marriage ruling; Repuke plays incest card

The Democratic candidate for Texas attorney general says he’s “not convinced” the AG’s office should appeal a federal judge’s ruling from Wednesday striking down the state’s bans on same-sex marriage.

Democrat Sam Houston, who’ll face one of three Republicans in the race to replace Abbott in November, questioned Abbott’s decision in a statement Thursday.

“I agree with Judge Garcia when he says ‘state-imposed inequality can find no refuge in our United States Constitution,’” Houston said. “There is no question that marriage is a right that should be afforded to all consenting adults regardless of race. In my view, the same right should be afforded regardless of sexual orientation, and I am not convinced Texas should commit substantial time and money to appeal a ruling that is likely to remain unchanged when considered by the U.S. Supreme Court.”

Railroad Commissioner Barry Smitherman also posted a statement in which he appeared to compare same-sex marriage to incest.

“From the founding of our Republican, states have always maintained the right to define marriage,” Smitherman wrote. “Whether it was a proscription on the ability of people to marry a first or second cousin or some other family member, or a prohibition on children getting married, states have always rightfully been the ones to define who could and who could not marry. Federal judges’ attempts in the wake of the Windsor case to usurp that power from the states must be halted immediately.”
