Feds: San Jose restaurant servers made less than $2.13 per hour


San Jose Restaurante Mexicano, located on Sparkleberry Lane in Columbia, has agreed to pay 11 employees $170,666 in back wages following an investigation by the U.S. Department of Labor's Wage and Hour Division, which found violations of the Fair Labor Standards Act's overtime, minimum wage and record-keeping provisions.

The FLSA violations resulted from the employer's failure to properly compensate employees for all work hours, according to investigators. By reviewing payroll records and conducting employee interviews, investigators determined that tip-earning employees, such as servers, were made to rely primarily on tips for pay, and consequently earned wages that fell below $2.13 per hour, in violation of the FLSA's minimum wage provision.

Additionally, other employees, such as kitchen staff, were paid flat salaries each month – without regard to hours worked – that did not satisfy minimum wage or overtime pay requirements. The employer also failed to maintain accurate records of employees' work hours and wages, as required.

The owner of the San Jose Restaurant at 801 Sparkleberry Lane is Leon M. Gregorio Jr. He bought it in December 2002 for $325,000. He lives in Lexington.

All that is from public records. For legal reasons I'm going to suggest you don't harass him.

There are other ways to find information than through Google, you know. I went to the Richland County site, which has a dandy viewer for property info. For instance, if you can find a lot on the map, you can get everything on record for it, including the current owner, the previous owners, what they all paid for the property, etc. etc. Want to know what your neighbor paid for his/her house, and what the appraisal value is now? Want to know who owns that rundown rental property down the street? Want to see who legally owns the land that your Walmart (or other chain store) sits on? You might be surprised.

Just as an exercise, you might locate the other San Jose restaurants in the area and see who owns them. Maybe Mr. Gregorio owns other restaurants and is doing the same thing elsewhere.
