UPPER WEST SIDE (WABC) -- Five months later and the pain is still just as sharp for Dana Lerner - in fact, it was even worse Thursday night. Lerner learned the cabbie found at fault in the death of her 9-year-old son, Cooper, won't spend a single day in jail.
"I felt like I was living on Mars all of a sudden," says Lerner, "like how is this possible? This makes absolutely no sense.
On January 10th, Cooper was crossing West End Avenue with his dad right in front of their apartment building, when police say driver Koffi Komlani failed to yield to the pedestrians, hitting them both and killing Cooper.

(28,209 posts)So many people are cavalier about entering a crosswalk. They will enter the crosswalk and look straight ahead as though there isn't the threat of a vehicle.
When I tell people to watch out, many say that they don't care if they get hit because they'll sue the driver.
Unbelievable! That's if they live from being hit. As a victim of a DUI driver, having my Buick Grand National hit from behind while stopped at a red light by a truck traveling at at 40MPH driven by a guy who blew a .2... the settlement money was nothing in turn for a damaged collectible and permanent chronic back problems.

While this driver is at fault, the pain and suffering won't be appeased by any amount of settlement.

I never trust anyone behind the wheel of a car, especially when walking (since there's absolutely no protection).
I've seen people blow through stop signs, I've had my foot run over (no damage), my hand hit when leaping back out of the way of a car ignoring a crosswalk. I don't trust any vehicle to yield to me. You have no idea who is driving, what they're on, what they're doing at the time, their mindset, whether they're even legal, etc.
I teach my kids to wait for the cars to pass.

(20,166 posts)I took a cab ride that was one of the craziest rides in my life. Had anyone dared to step in the street as we flew down to Grand Central Station (or pulled out in front of us), there's no way the cabbie could have stopped in time.
