Fortenberry attorneys seek to allow expert witness on 'cognitive aging' to testify

Defense attorneys for indicted U.S. Rep. Jeff Fortenberry are seeking to call an expert on memory to testify that the 60-year-old congressman didn’t recall the origin of some 2016 campaign contributions because of his age and because of “repetitive” questioning by federal agents.

In court filings Thursday, prosecutors and Fortenberry’s attorneys also spatted over whether any evidence would be presented during the trial about the alleged political motivations of the lead U.S. attorney prosecuting the case.

The congressman’s attorneys maintain that he was targeted because he’s a Republican; prosecutors say such claims are false and an attempt to divert attention away from his alleged crimes.

Fortenberry, who has represented eastern Nebraska’s 1st District since 2005, stands accused of lying to federal investigators probing illegal “conduit” campaign donations in 2016 that originated from a Nigerian billionaire.

Fortenberry is accusing the prosecutor of being biased because he has donated to Democrats, but the prosecutor has also donated to republicans.

He is trying to portray that he was confused rather than a liar over the source of the donations, so he wants to bring in an expert witness, a professor whose area is aging and memory.

I've followed this from the day he the FBI announced he was under investigation. He and his wife sat in their car for an interview and tried to tell reporters they had no idea why he was being investigated by the FBI.

The OWH carried a story on it today, also. I found this remark by the prosecutors amusing:

Prosecutors called that argument absurd. They noted that Chagoury gave to both Republicans and Democrats and said Fortenberry is “not a prominent politician in (California) or otherwise widely known outside of his district.”

So basically, who do you think you are, Fortenberry?
