Flint wants Mich.court to rule it an arm of state during water crisis

LANSING — The City of Flint wants the Michigan Supreme Court to rule on whether the city was an arm of the state while under a state-appointed emergency manager when the city’s water supply became contaminated with lead.

How the state’s high court rules — if it agrees to consider the question — has major implications for which level of government has liability for the water crisis, as well where various lawsuits will be adjudicated.

Lawyers for the city and three former city officials asked the Michigan Supreme Court to take up the question in a filing this week

They want the court to overrule the Michigan Court of Claims, which ruled last August that the city was not an arm of the state, and said lawsuits arising from the crisis should be tried in Genesee County Circuit Court, not the Michigan Court of Claims.
