High Court denies effort to reopen abortion clinic
The Kentucky Supreme Court has decided a Lexington clinic that provides abortions must remain closed for now while Gov. Matt Bevin's case against the facility proceeds.
The EMW Women's Clinic in Lexington shut down in June after the state Court of Appeals issued a temporary injunction in a ruling that overturned a Fayette Circuit Court judge's prior decision to allow the facility to remain open. The clinic appealed to the Supreme Court, but that request was denied Thursday.
Earlier this year, two surveyors from the state's Cabinet for Health and Family Services came to inspect the clinic. They learned that the facility solely offered abortion-related services and saw what they perceived as unsafe and unsanitary conditions there, including dust-covered medical equipment and long-expired medications, according to the decision the Supreme Court issued this week.
The Bevin administration sued the clinic, alleging that EMW qualifies as an abortion facility and has been operating without the necessary license from the cabinet. That case has not yet been decided.
