More California gun control: Could it lead to recalls?

San Francisco Chronicle / 10-1-13

Gun-rights advocates are ready to launch a recall attempt aimed at some of California's most vulnerable Democratic state lawmakers - and the party's supermajority hold on the Legislature - if Gov. Jerry Brown signs some of the dozen-plus gun-control bills sitting on his desk.

Brown wouldn't be a recall target, organizers said. The costs are too great - perhaps $2 million - to gather enough signatures to put a statewide recall on the ballot.

Instead, gun-rights activists are focused on legislators who voted for the gun bills before Brown, a list that includes nearly every Democrat in Sacramento.

Gun-rights activists won't charge into battle over just any of the gun laws sitting on Brown's desk. But a few - like AB374, which would ban the sale or possession of any semiautomatic rifle capable of holding a detachable ammunition magazine - would be equivalent "to an erasure of the Second Amendment," said Assemblyman Tim Donnelly, R-Twin Peaks (San Bernardino County), a Tea Party favorite who is at the vanguard of the recall effort and is running for governor next year.

Do we gamble our supermajority based on threats by assault weapons advocates?

Yes. Screw them.

1. As I read it, AB374 is over the top. A detachable magazine does not equal and assault rifle.

We already have limits on magazine capacity, that's quite enough.

To call a .22 caliber plinker with a 5 round magazine an assault rifle borders on madness.

If it passes I fear for the recalls and I don't think it's at all worth the political risk.

Things are going so well in California, we already have pretty strict gun laws.

I don't get it.

2. I agree that SB 374 is excessive (as are a number of the other bills), but it is specific

to centerfire rifles. So the typical .22 plinkers are safe, at least.

Guess Gov. Brown is saving these until the end - he has until 10/13 to sign or veto...

4. Lead ammo ban makes sense, we banned it in SG shells a long time ago, iirc.

What do you know about the other bill he vetoed that, as a part, would have impacted DUI convictions?

5. I have to admit I didn't pay much attention to that one, and looking back

I see a lot of confusion about what it would have covered. But as described - 2 DUIs and you become prohibited for 10 years - I'm glad he vetoed it...

Paul Song, executive chairman of the Courage Campaign, an advocacy organization that supported the gun bills, said in a telephone interview that Brown appeared to be trying to defuse a possible campaign issue as he runs for re-election next year. The organization later released a much stronger statement accusing the governor of "cowardly behavior" and saying he "will have blood on his hands."

Sam Paredes, executive director of Gun Owners of California, said gun owners' rights groups will consider mounting recall campaigns or election-year challenges against Democratic lawmakers who voted for the gun bills. Final votes on the legislation occurred last month, just as two Colorado state lawmakers were recalled for supporting tougher gun laws in that state.

Paredes predicted lawsuits challenging bills that require safe storage of handguns, Skinner's high-capacity magazine bill, and legislation requiring that buyers of rifles and shotguns pass a safety test.

Still, he said, "We were only shot in the heart six times instead of 12 times, and I guess we should be happy with that."
