Tenants Triumph Over Google Attorney

In a San Francisco Ellis Act eviction case that included mass protests and the blocking of Google buses, a court has stopped the eviction of tenants at 812 Guerrero by Google attorney Jack Halprin. The case, Jack Halprin v. Claudia Tirado and Alexandre de Queres Barros (CUD-15-651654), represents another major victory for tenants facing eviction under the Ellis Act.

Judge Ronald Evan Quidachay ruled on May 6, 2015 that Halprin had not complied with the Rent Ordinance because he never paid any of the first half of the statutory relocation payments as required by the Rent Ordinance to either Claudia, Alexandre, or their son, Valentino.

It was another remarkable legal victory for attorney Stephen Collier of the Tenderloin Housing Clinic, who along with colleague Joseph Barber represented Claudia, Alexandre, and Valentino in the unlawful detainer action. Collier and Barber also represent two other tenants at the building (Christopher Sideris and Evan Wolkenstein, local musician and teacher respectively) in their unlawful detainer cases. Rulings in these other two cases are pending, but similar issues are involved.

The tenants were able to receive such high quality legal representation because former tenant attorney Mayor Ed Lee tripled Ellis Act eviction defense funding in late 2013. Quality tenant legal defense is now even more critical with the legislative failure of Ellis Act reform this year.
