So, I'm 55 today

And I just found out I've torn my labrum in my right shoulder.
My work will not hold my job. I have to 'voluntarily resign' at the end of the month.
I found out I can sign up for the family leave act and hold on to it for 12 weeks.
I still have to see if it is from the date of injury or the date I send it in.
My orthopedic doc told me it's a 4 month deal, but I will work my behind off
to get back as early as possible.

I called a lawyer and he told me about the FMLA.
I wasnt going to get a lawyer, but telling me that
I'm losing my job when I got hurt ON the job just isnt right.

Throw away worker, Maybe I'll change my handle, that or thread killa.
I have been trying to be upbeat today (well, everyday), but dang it's tough

Anyway, Thanks for reading my rant.
Have a good night.

Dave

have the lawyer represent you to workers comp, they will take a portion of your check, but that's better than having no representation. Been there, done this.

I am in WA, so this link will tell you about my state, but you might check into your state's policy

Sorry about your shoulder, that is not a very good gift at all. Take care of it and yourself, you will get through this and hopefully have a happy 56th birthday

I live in Georgia. I was working as a temp in Kennesaw, GA., in the '90s. I slipped on ice in front of the office building and cracked my hip bone. Worker's comp paid all medical bills, plus $250 a month as long as I was laid up.

There are lawyers here in Georgia advertising on TV that if you were injured on the job, they will get you compensation.

Plus, I sued the company and got $30,000, though the lawyer got one-third of that.

A cracked hip bone is no picnic. Hope you healed well and don't have pain in your hip now.

Yes I'm getting WC, but havnt been on the job (12 mo) to qualify for FMLA, so a letter I got
today told me.
Yes, I'm talking to lawyers, and it seems I should be alright, but losing my insurance for the kids blows.

I go in on Tuesday(3-20) for the surgery.
I'll keep anyone interested informed.
Once again, thanks for everything, you guys ROCK!

14. Good luck with everything - shoulder surgery is no fun!

With shoulder surgery, expect the joint to be immobilized for a month other than passive flexing to keep your joints from freezing. Physical therapy for two months or more. If you work at the physical therapy, you might be able to get back to work fairly soon, if you don't have to lift and carry stuff.

I am not a doctor but I've had surgery on both shoulders - the first was from a serious injury that tore cartilage and ligaments. The second was just age and wear, but both took roughly the same time to heal and to get back to strength. While you can work hard at the physical therapy to regain strength, you can't push it too fast or you will undo the repair.

I don't know what kind of work you do but if yours requires physical labor, is there another job they can let you do while you finish healing?

When I worked at the Florida Workman's Comp back in the 1970s, companies had to provide at lot of help for workers who were injured on the job. It is well worth making sure the company you work for is doing what they are required to do.

Sleeping lying down may be difficult - a recliner is very good to have, IF the controls are not on the side that is healing! Yo may be able to find used lift chairs on Craigslist for not too much. If you live anywhere near Tallahassee, Florida, I have one I will be selling cheap real soon, as soon as my new one gets here.

I tore up the left in 99, and while at PT, the muscle bound jerk dislocated my shoulder
(Dont want that to freeze up, he sez)
I couldnt figure out why I was waking up with pain again.
My doc asked me when I dislocated it, and then I KNEW.
Since it was after the fact, I couldnt go back on him...hope he didnt hurt anyone else.
I was pretty juiced on vic's and I was STILL screaming.
He had to know he did something.
Anyhow I had to get the joint cut out as it kept getting higher and higher up.
I swear I looked like Quasimodo.
I live outside philly, so picking up the chair would be a long haul.
Thanks, tho, I appreciate it.

I just wanted to stay at a job for awhile.
My lucks been running pretty muddy the last 5-6 years,
took jobs that turned out to be, well, pretty shitty.

I hoped I could stay here long term, so oh well...

Thankis for the kind words, I'll keep ya informed.

I guess I've been lucky with my physical therapists - they've always been very careful with me. That could have something to do with me being a woman, though.

I got my old lift chair for $50 off Craigslist the day after my right shoulder surgery. I knew I wasn't going to be able to sleep lying down but hadn't thought about not being able to control the recliner. I see lift chairs regularly on Craigslist under the "Health & Beauty" category, but usually they are $300-400. The one I have is not the most comfortable, but it got me through the shoulder recovery and I now use it in my library as my chair to do my needlework in.

My Dad could use the old lift chair but he won't admit that he needs one. Once I recover from my surgery, we may just load up the old chair and haul it downstate for him to try out!

I got my left shoulder rebuilt in 1993. The right one got worn out while doing data entry and running a team during the 2008 campaign. I got it "cleaned out" in early 2009. Now I'm going for new knees and I want a more comfortable chair to spend my recovery in!

I hope you can keep your family's insurance - working people should not lose when injured on the job! Good luck!

I'm a dave too and just last month I had my first workers comp injury in a lifetime of working, I'm 60+ and had to

on the dole for three weeks. I was lucky to have a great WC rep that started my wages the day after my accident

happened because my place of employment would not let me come back at light duty. Now after three days back, I

think I should have waited to return but aren't sure how that's gonna go. My boss, if you could call him that, told me

he preferred that I healed completely before returning but I told him I was afraid that if I missed any more time I'd

be down the road because they'd come up with some shit about my position not being needed or similar.

Of course he said that would never, ever, ever happen.

good luck and do keep us posted
