Female Mountie suspended seven days for sex in a police car with boss

VANCOUVER -- A female Mountie will be docked seven days pay and should receive a medical discharge as punishment for having sex in a police car with her boss, a discipline board ruled Thursday.

The three-officer RCMP misconduct panel decided not to terminate RCMP Const. Susan Gastaldo after finding her guilty last December of disgraceful conduct.

But board chair Supt. John Reid was critical of Gastaldo's misconduct, noting she repeatedly lied about having an affair with her boss, including lying to her husband.

"Her lies are a reflection of her inability to tell the truth," Reid said the cumulative lies and deceit reveal a fundamental character flaw.

The chair said Gastaldo has lost all credibility and should receive a medical discharge from the force by the commanding officer.

A medical discharge would allow Gastaldo, a 14-year veteran of the force, to leave the RCMP with pension and other benefits.

They have "consensual" sex. He lied about it. She lied about it. He gets off with a smack on the wrist, she loses her job and has to continue psychological counselling.

Seems fair to me.

It’s the second case in recent months in which a female RCMP officer alleges she was sexually harassed. In October, Const. Susan Gastaldo claimed her boss coerced her into having sexual relations.

The latest case highlights the need for a RCMP union, said Mike Webster, a psychologist who often works with police forces.

“(Sexual harassment) is as frequent in a municipal police department or fire services, as it is in the RCMP,” said Webster, a former Mountie.

“The difference being, in a municipal police service or fire service, the female victim has a union. She can take her complaint forward, sit down with management, they iron it out . . . and she can go back to work. In the RCMP, that doesn’t exist.”

Pearson was asked to try to get Gastaldo back to work, but instead began a sexual relationship with her as she returned to work part-time.

The misconduct hearing began last September and heard allegations from Gastaldo that she was coerced into having an affair with Pearson, who was in charge of Special O, which conducts covert surveillance on targets of criminal investigations.

The board rejected Gastaldo's claims, which included an allegation of rape, and found the affair was consensual.

But even if it was, this ruling stinks.

If there was coercion, we're in much deeper and murkier water.

I agree that the discipline should have been equal. If not, the superior officer should be the one more sternly disciplined, since he should know better by being more senior.

However, in terms of her judgment, maybe her husband sucks in bed or is abusive or is a lazy ne'er do well who can't hold a job. Maybe she just found out her husband had an affair and when her boss came along, she slept with him to get back at hubby?

Her boss was only suspended for ten days of pay but she is forced out of her job? He gets a slap on the wrist and she loses her career. That is outrageously unfair and an affront to women.

The senior officer in that sort of case should be the one to take the majority of the blame and get the majority of the discipline. It should be an affront to the mounties in general and their chain of command.
