It's not written in the Constitution "Thou shalt have this and this many justices on the Supreme Court". Congress has changed the number several times- Once to prevent Andrew Johnson from appointing one. They would only need to reduce the number of justices to 8 (A completely cynical partisan move that the whole world would see through, but who cares?) with a tie upholding the ruling of the lower court- which, conveniently, the Republiclowns have been packing with partisan conservatives for decades.
