(3,595 posts)Although the first problem is that it is a white girl in the car with what appears to be a minority. That is their "probable cause."
Once the excuse of the smell of marij is introduced, they have the right to get him out of the car to search for the substance or a weapon.
The kid refuses. From that point, they could have kicked the shit out of him. They didn't. It looks like he was struck a couple of times -- not clear from the video.
He was tased. That got him out of the car. There is no indication he was roughed up after he got out of the car.

So, get out of the car.

(18,133 posts)And yes "I smell marijuana" is BS so I don't find the command lawful. He had the opportunity to peacefully deal with the situation by waiting for the parents to arrive, or issuing a legitimate summons for something not apparent in the video, but instead chose to escalate because that's was douche bags do.

Yeah, marijuana is illegal and so are Cuban cigars... when's the last time a banker got tazed in his car for smoking a Cuban.
Cop didn't like having his authority questioned and decided to teach the kids a lesson by tazing the black one - pretty clear to me.
The cop may have technically acted within the law - but that doesn't make his action morally right.
It's time we made serious cuts in policing budgets and put the savings towards education, job training, housing, and drug and alcohol treatment. Let's create a safer and healthier society by helping each other rather than terrorizing people for not submitting to authority.

Place the officer involved in a room, by his/herself and play the video for the officer ... and record his/her physical response to the video. And use that response to determine whether that officer is to return to the streets.
I can't imagine seeing/hearing myself acting like this, and not being horrified by the over the top escalation. And, any officer viewing themselves in that setting without showing a negative physical response (revulsion), is an officer that should never be on the street again.
Oh, yeah ... Observation:
The Black male in the backseat that was "17 Yrs Old, sir" that got pepper sprayed, tased and dragged out the vehicle, was more correct in the pronouncing and assertion of his rights, than the female driver.
Both were equally forceful in the assertion of their rights; however, the male (arguably) was merely pronouncing and asserting his rights, in response to the officer's attempt to violate those rights; whereas, the female (despite getting some of it wrong) was (arguably) verbally combative.
I wonder why?
Speculation: The Black male in the backseat that was "17 Yrs Old, sir" that got pepper sprayed, tased and dragged out the vehicle, has a relative (probably his mother) that advised him to provide that "I'm a juvenile and you can't do anything to me (except in extreme circumstances) until my parent(s) get here" response.
Speculation 2: the Black male's college expenses, including a nice apartment with all the toys and new vehicle, will soon be funded, courtesy of that Virginia Police Dept.

(7,318 posts)Since you are the one to make a blanket statement, lets explore that. According to what you said if someone runs over multiple people and commits a hit and run with injuries and the police drag them out of the car it is assault. You cant be serious.

If a police officer gives you a lawful command to exit the vehicle then what they did was correct. How about this, when can a police officer pull someone from their vehicle in your world?

(625 posts)I think pot should be legal. But that's beside the point--the cops have to enforce the law.
Granted, they don't have to be this violent and prickish about it, but driving around while smoking pot really isn't a good idea.

(24 posts)it will not stop. Once dirty police start going to jail, thereby ruining their careers, the outrageous police behavior will stop. Police feel emboldened because they see civilians as the enemy and they ALWAYS beat the enemy.
Every single bad cop out there needs to be arrested, charged, and kicked off the force.
