Banker's Conference Crashed by Woman About To Be Evicted



On Thursday, dozens of homeowners and supporters joined Betty Badro in confronting Wells Fargo CEO John Stumpf at a banker's conference on the day before her home of 19 years is scheduled to be foreclosed. Ms. Badro, who has worked for the State of California for 22 years, attempted to deliver a personal check to Wells Fargo CEO John Stumpf while he was giving a keynote address at the American Banker Retail Lending Conference at a luxury beach resort hotel in Carlsbad, California.

Betty has spent months attempting to get Wells Fargo to consider her for a loan modification. Betty lives with her disabled brother and one of her two children, and suffered recent financial setbacks due to state furloughs and personal health issues. Her finances have now recovered, a HUD-certified housing counselor has reviewed her case, and believes that Ms. Badro qualifies for a loan modification.

Ms. Badro took the stage, shook hands with Mr. Stumpf, and proceeded to explain that his bank was poised to take her home the next day. She told Mr. Stumpf that she can afford the mortgage and had a check in hand that she was asking him to accept. Not saying another word, Mr. Stumpf turned his back on Ms. Badro and left the stage. As presumably other bankers attending the conference attempted to restrain Badro while calling for "security," she bravely stands her ground and insists on telling the crowd her story.

Then the entire group of fifty homeowners took over the stage and made a presentation outlining how Wells Fargo has failed the community and the changes that Wells Fargo should make in their foreclosure practices...

the man who had his condo taken by Wells Fargo when he was current on his payments, due to a typo. He died in court.

homeowners faithfully making their payments as those in pre-foreclosure.

Months after I learned the tactics used by banks/mortgage servicers to manufacture supposed defaults, my own son came over and told me his servicer increased his monthly payment by $800. He is now represented by counsel.

I know of a woman who resides in Georgia who is defending a foreclosure in Florida. Her name doesn’t appear on the Deed or the mortgage, yet she was sued.

I know of a man who unknowingly paid off his mortgage 9 years ago, perhaps thinking he purchased a 30 year loan not a 20 year. For 9 years his servicer cashed his checks and never notified him the mortgage was paid. A friend of his had checked the land records and learned the mortgage was paid, so the homeowner checked himself and ceased sending payments. Now the homeowner is understandably worried that his servicer will manufacture bogus documents and try to foreclose/steal his property.

I know of a woman who inherited a home that had a small mortgage which she attempted to pay off. Her efforts were ignored in favor of foreclosing on the property. First, her father passed, next she found herself in a battle with banksters.

My own niece was recently sued in foreclosure on a commercial property in a neighboring state. She was estranged from the business and her partners for the past 12 years. We vacation together and I had shared with her what I learned about mortgage/foreclosure fraud in my research over the past few years so she understood she should obtain counsel. Sure enough her counsel mirrored all I had said about MERS, Assignments, standing, forgery, securitization, etc. Her counsel blew that foreclosure out of court and I feel validated.

Rather than await my turn in this bankster scheme to steal real property, years ago I checked my mortgage then the land records. I discovered fraud and Title problems and spent months seeking competent counsel, hired them, sued and am awaiting trial.

Homeowners please – take your eyes off the sum of money you supposedly owe on your mortgage loans. Focus on the creditor side of the transaction because there are crooks on that side who likely owe you damages.

Was there fraud at loan origination? Is MERS in your mortgage? Does your state require that all mortgage assignments be filed in the county land records? Was your mortgage loan properly and legally securitized? Is your chain of Title sound, without breaks or gaps? Did MERS breach your mortgage contract? Did MERS cloud your property Title? Are any invalid documents filed on your property? Did your servicer maintain a proper accounting of your mortgage loan? Will your servicer answer a Qualified Written Request or violate federal law?

I find it so much more fun to concentrate on the damages owed to me rather than by comparison the pittance that may be due on my mortgage loan which under PA law is actually unsecured debt because under PA law my mortgage has been null and void since early 2007.

If a homeowner is going to sit and sign checks each month, shouldn’t they be certain their mortgage remains valid and that no party owes them damages?

I liked the way the Ms. Bardo kept reminding him that it was illegal to touch someone without her consent. I might have been tempted to cold-cock the SOBs...
