UK wants authority to serve warrants in U.S.
WASHINGTON - British and U.S. officials have been negotiating a plan that could allow British authorities to directly serve wiretap orders on U.S. communications companies in criminal and national security inquiries, U.S. officials confirmed Thursday.
The talks are aimed at allowing British authorities access to a range of data, from interceptions of live communications to archived emails involving British suspects, according to the officials, who are not authorized to comment publicly.
The negotiations were first reported Thursday by the Washington Post.
Under the proposed plan, British authorities would not have access to records of U.S. citizens if they emerged in the British investigations.

From the Washington Post:
If U.S. officials or Congress do not seek changes in the British standards, what it means is theyre going to allow a country that doesnt require independent judicial authorization before getting a wiretap to continue that practice, which seems to be a pretty fundamental constitutional protection in the United States, said Eric King, a privacy advocate and visiting lecturer in surveillance law at Queen Mary University of London. Thats being traded away.
Senior administration officials said that they are seeking to relieve the pressure on U.S. companies caught in a conflict of laws. The United States bars American firms from providing intercepts to anyone but its government after U.S. law enforcement has obtained a court order. Britain wants to directly compel the production of the data and has already passed legislation to make that happen.
