Julian Assange is no folk hero and UN is out of order

... Assange is not being detained by anyone except himself ... He entered the Ecuadorian embassy of his own volition in 2012 and sought sanctuary there while he was on bail awaiting extradition to Sweden on charges of sexual assault and rape. The sexual assault charges have been dropped but the rape charge remains. Does the UN really think it is wrong to extradite an alleged rapist to a land whose legal and penal systems are among the most civilised in the world?

If it does, perhaps it would like to explain where this judgment fits with its secretary-general’s campaign to end violence against women and girls. “Break the silence,” demands Ban Ki-moon on the UN’s website. “When you witness violence against women and girls, do not sit back. Act.” Except that if you do act and attempt to extradite an alleged rapist, you then get attacked by another branch of the UN for denying the alleged rapist his human rights. Work that one out if you can.

... whatever you think about the activities of his website WikiLeaks, the extradition case is not and has never been about that. It is about accusations that were made against Assange by women he met on a lecture tour. Assange claims he should not be extradited to Sweden because it could all be part of a plot to have him extradited to the US. But that is absurd. If the US wants to prosecute Assange it can seek extradition directly from Britain. If he is innocent as he says he is, why didn’t he get on a plane to Sweden to answer charges? He could have cleared his name.

... People such as him can only exist in countries like Britain that respect the right to free speech. Anywhere else, they would quickly disappear. That is a point rather lost on the UN’s working group on arbitrary detention ...

the US flew a 'rendition plane' out when they thought they might be able to scoop up Snowden, but Assange never had to fear being handed over to the US if he went into custody. Right.....

with Swedish authorities regarding sexual conduct complaints from several women during the time he was there. Assange attempted unsuccessfully to quash the warrant in the Swedish courts, and his year-and-a-half contest of the warrant also failed in the UK courts, at which point he jumped bail

Mr Assange reportedly has sex with a woman he met at the seminar on 14 August, identified as "Miss W".

Some time between 17 and 20 August, "Miss W" and "Miss A" are in contact and apparently share with a journalist the concerns they have about aspects of their respective sexual encounters with Mr Assange.

20 August 2010

The Swedish Prosecutor's Office issues an arrest warrant for Mr Assange on allegations of rape and molestation.

Both women reportedly say that what started as consensual sex became non-consensual.

Wikileaks quotes Mr Assange as saying the accusations are "without basis" and that their appearance "at this moment is deeply disturbing". A later message on the Wikileaks Twitter feed says the group has been warned to expect "dirty tricks".

The arrest warrant is withdrawn. "I don't think there is reason to suspect that he has committed rape," says one of Stockholm's chief prosecutors, Eva Finne.

Prosecutors say the investigation into the molestation allegation will continue but it is not a serious enough crime for an arrest warrant.

The lawyer for the two women, Claes Borgstrom, lodges an appeal to a special department in the public prosecutions office.


18 November 2010

Stockholm District Court approves a request to detain Mr Assange for questioning on suspicion of rape, sexual molestation and unlawful coercion. Ms Nye says he has not been available for questioning.

By this time Mr Assange has travelled to London. His British lawyer, Mark Stephens, says his client offered to be interviewed at the Swedish embassy in London or Scotland Yard or via video link. He accuses Ms Nye of "abusing her powers" in insisting that Mr Assange return to Sweden.

Why the ‘case’ against Julian Assange in Sweden should be dropped, and dropped now!

a) The Snowden documents on the Assange case, revealed by Glenn Greenwald

“The United States on 10 August urged other nations with forces in Afghanistan, including Australia, United Kingdom and Germany, to consider filing criminal charges against Julian Assange, founder of the rogue WikiLeaks Internet website and responsible for the unauthorized publication of over 70,000 classified documents covering the war in Afghanistan. The documents may have been provided to WikiLeaks by Army Private First Class Bradley Manning. The appeal exemplifies the start of an international effort to focus the legal element of national power upon non-state actor Assange and the human network that supports WikiLeaks.”

Secondly, This request was put forward on the 10 of August 2010. In the document “Affidavit of Julian Paul Assange”, we read that it was around that date when Sweden took decisive steps to “consider filing criminal charges against Julian Assange” – as requested by the U.S. government.

b) Mr. Assange was never accused by the two Swedish women. The investigation of “suspicion” of misconduct was initiated by decision of the Swedish police authority:

As early as 2011, the publication of the interrogation protocols including the testimonies of the two women clearly illustrated that they did not sustain any accusation of misconduct against Mr. Assange. The police instead, by their own decision and initiative, raised the case of suspected misconduct after one woman sought help to identify the location of Mr Assange, and the police took it to a prosecutor. However, Chief Prosecutor Eva Finné after reviewing the evidence she then dismissed the whole thing as without ground. Why was the preliminary investigation of the “case” reopened?

A Feminist Lawyer on the Case Against Wikileaks' Julian Assange

It is curious that charges against Assange were brought, dropped almost immediately, and later reinstated. The fact that authorities were so quick to charge Assange based on uncorroborated testimony should raise questions about whether prosecutors are treating him differently from your run-of-the-mill alleged sex criminal. However, it's pure rape culture apology to argue that so-called "he said/she said" cases should be automatically dismissed in favor of the alleged rapist.

We can agree that the legal response to what Assange allegedly did reeks of politically-motivated prosecution without passing judgment on the merits of the allegations against him.

No DNA link to Assange in condom central to sex assault case

A ripped condom given to Swedish police by one of Julian Assange’s accusers does not contain the WikiLeaks founder’s DNA, forensic scientists have reportedly found.

Assange claims he had consensual sex with the woman, but denies intentionally tearing the condom. He had previously told police that he continued to stay at her residence for the week following the alleged incident, saying his accuser never made any mention of the ripped condom.

But DNA purportedly belonging to Assange was present on a condom submitted by a second woman, who has accused him of rape, prompting Swedish authorities to push ahead with their bid to have him extradited from the UK.

However, his second accuser, now 29, who claimed to have been raped in her sleep by Assange, apparently told police she had not been opposed to having unprotected sex with him despite previous statements to the contrary, the daily reported.

Why I am Convinced that Anna Ardin is a Liar

There are so many inconsistencies in Anna Ardin’s accusation of sexual assault against Julian Assange. But the key question which leaps out at me – and which strangely I have not seen asked anywhere else – is this:

Why did Anna Ardin not warn Sofia Wilen?

On 16 August, Julian Assange had sex with Sofia Wilen. Sofia had become known in the Swedish group around Assange for the shocking pink cashmere sweater she had worn in the front row of Assange’s press conference. Anna Ardin knew Assange was planning to have sex with Sofia Wilen. On 17 August, Ardin texted a friend who was looking for Assange:

“He’s not here. He’s planned to have sex with the cashmere girl every evening, but not made it. Maybe he finally found time yesterday?”

Yet Ardin later testified that just three days earlier, on 13 August, she had been sexually assaulted by Assange; an assault so serious she was willing to try (with great success) to ruin Julian Assange’s entire life. She was also to state that this assault involved enforced unprotected sex and she was concerned about HIV.
