MILWAUKEE Milwaukee County District Attorney John Chisholm said the fatal shooting of Dontre Hamilton in Red Arrow Park was 'justified self-defense.'
Chisholm called for a special investigation into whether charges should be filed against former Milwaukee police officer Christopher Manney in the April shooting death of Hamilton.
Manney, 38, approached Hamilton after receiving a complaint that he was sleeping in Red Arrow Park.
Police Chief Ed Flynn said Manney approached Hamilton, identified himself and asked Hamilton to stand up. When Hamilton stood up, Manney approached Hamilton from behind, reached under Hamiltons arms, placed his hands on his chest to conduct a pat-down search and asked if Hamilton had any weapons.
As Manney began the search, Hamilton began fighting with Manney............

Gov Walker has said the National Guard is on standby. there have been protests for weeks in Milwaukee over this case. Dontre Hamilton was sleeping in the park when he was confronted by police where there is an ordinance against this.

Protests have become a regular occurrence in downtown Milwaukee on Friday evenings. Supporters of the Dontre Hamilton family gather where he died at Red Arrow Park. They continue waiting for the District Attorney to decide whether hell file criminal charges against former officer Christopher Manney.
The MPD fired Manney for failing to follow protocol in confronting Hamilton, as he slept in the park. The 31-year-old was mentally ill and unarmed. He reportedly began struggling with the officer, who then fired 14 shots, killing Hamilton.
This past Friday, about 100 demonstrators walked from Red Arrow Park, onto I-43, blocking rush-hour traffic......................

The saying on the supervisors shirts refer to some of Eric Garner's final words. Garner died in New York City after police there placed him in a choke hold.
Supervisors Khalif Rainey, David Bowen, Martin Weddle, Willie Johnson and Michael Mayo said they believe Manney should be charged for Hamilton's death. The men also spoke of the need for humanity and justice.

The Wisconsin National Guard has started calling up members to respond to potential protests related to the fatal shooting of a man by police.
MILWAUKEE (AP) -- The Wisconsin National Guard has started calling up members to respond to potential protests related to the fatal shooting of a man by police.
National Guard communications director Maj. Paul Rickert says there's no mission yet, but Guard members will be ready if needed. Milwaukee County Sheriff David Clarke Jr. requested the Guard's assistance after 74 people were arrested in a weekend protest that blocked Interstate 43.
The April death of Dontre Hamilton has led to a series of protests in Milwaukee. Demonstrators want prosecutors to charge former police officer Christopher Manney in the killing.

(7,650 posts)I'm unclear if no-indictment decisions for police violence is actually a new trend, or is the national media just reporting on these decisions because of the protests in Ferguson, NYC and elsewhere?
(To be clear, to avoid any confusion, I think no-one (cop or otherwise) who appears to inflicts gratuitous harm on another person should be allowed a free pass so as to avoid a proper criminal trial. I'm just unclear as to to whether this is a new trend.)

The Wisconsin National Guard began calling up members over the weekend to respond, if needed, to protests in Milwaukee related to the fatal shooting of Dontre Hamilton by a Milwaukee police officer.
Milwaukee County Sheriff David A. Clarke Jr. made the request, which was approved by Gov. Scott Walker, Maj. Paul Rickert, the Guard's director of communications, said Sunday.
"We are currently making preparations to stage National Guard members and will be ready to respond rapidly if needed," Rickert said. "We don't have a mission yet but should we be needed, we will be able to send those forces."
Clarke's request Saturday came one day after protesters blocked traffic on I-43, an action that resulted in the arrest of 74 people.
Hamilton's death has prompted a series of protests in downtown Milwaukee. Demonstrators have called for Milwaukee County District Attorney John Chisholm to issue charges against former officer Christopher Manney in the fatal shooting of Hamilton on April 30 in Red Arrow Park.......

A tragic incident but this is the only decision the DA could make given the circumstances and evidence.

Witnesses say that a scuffle occurred between Manney and Hamilton, in which Manney took out his baton and then Hamilton grabbed it and swung at Manney. Then Manney fired his gun.
The gun that Manney used can be discharged 14 times in less than three seconds.
Police officers are taught to shoot until the threat they face is stopped.
Theres no legal or police procedural standard for how many times a cop can shoot a suspect. So although 14 shots may seem excessive, theres no standard for determining how many shots are excessive.
Manney was treated for head trauma and is still being treated for trauma."

Why I Was Arrested Standing Up for Dontre Hamilton in Milwaukee

This weekend I spent 24 hours in jail for protesting the death of Dontre Hamilton, the unarmed man shot 14 times by a Milwaukee police officer in a downtown park. I am compelled to write about my experience to share why I chose to join this protest and to correct the narrative law enforcement leaders in Milwaukee have used to inaccurately paint a picture of the protests and arrests.
While my conscience continues to be deeply moved by Dontre's case and his loved ones' grief, I came to protest because of my concerns with the larger system -- that the American justice system produces different outcomes for people at every level from profiling and arrests through sentencing, parole, and killing based purely on race and class. I am not anti-police. I've been mugged at gunpoint twice in my life, and I don't want to be a victim of crime again. Despite the many good officers who have helped me and my empathy for their very difficult work, I believe the system is set up to differentially enforce laws, and protect those who abuse their power to enforce the law.
Dontre's case is one where I believe the officer should face criminal charges. At a downtown Starbucks in Milwaukee's Red Arrow Park, a worker called police to complain about a man sleeping in the park (another worker criticized the call publicly and disputed that he was a problem). Police officers came twice to check on Dontre, saw nothing wrong, and left. Officer Christopher Manney, unaware other officers had stopped, confronted Dontre Hamilton and tried to pat him down. Hamilton, who had a history of mental illness, resisted and a confrontation ensued. Officer Manney tried to subdue him with a baton and Hamilton got the baton and swung at him, hitting the side of his neck. Officer Manney shot Hamilton 14 times including in the back to kill him. Police Chief Edward Flynn fired Officer Manney not for excessive force but for not following protocols in dealing with an emotionally disturbed person. He was not dangerous, did not deserve to be confronted, and certainly should not have been killed. We are waiting to find out if Milwaukee's District Attorney will press charges.
As we all know, other District Attorneys and grand juries have not pursued criminal charges against police officers who have killed clearly innocent or unarmed African American men. One cannot look at the cases of Michael Brown, Eric Garner, Dontre Hamilton, John Crawford (the man shot at Wal-Mart in Dayton), Tamir Rice (the 12 year old shot on a Cleveland playground), and many other recent cases and think that there is not a larger problem with police assuming African American men and boys are inherently dangerous. None of these men should be dead, and none of their families should be grieving. ......

Milwaukee District Attorney John Chisholm said on Monday he will not press charges against the former officer Christopher Manney because he acted in self-defense when he shot Dontre Hamilton 14 times during a struggle in Red Arrow Park in downtown Milwaukee on April 30.
A few hours after that, the Justice Department through its offices in Milwaukee said it will conduct a review of case to determine if federal civil rights laws were broken.

Apparently, the officer shouldn't have frisked him for some reason having to do with his mental illness (not that I'm seeing how that makes any sense), but that doesn't mean that the guy had some kind of right to beat resist and certainly not to beat the officer. Same would have gone for a civilian. Since when is anyone expected to just allow someone to beat them? Of course it was self-defense and a pretty obvious case of one.
