Attorney: Fake Democrats in Wisconsin committing criminal election fraud

Six fake Democrats running in upcoming recall primaries to push back the election date in Wisconsin are violating the law, according to an election attorney.
Among the requirements for running as a candidate in a partisan primary, one is required to file with the (Government Accountability Board) a Declaration of Candidacy, form GAB-162. That form specifically requires a candidate to state that their candidacy is representing the political party for which the primary is to take place. This statement must be made under oath, attorney Jeremy P. Levinson said in a memo (PDF) to We Are Wisconsin.
Clearly, a candidate running in a Democratic primary for the purpose of disadvantaging that party and giving electoral advantage to the Republican Party and the Republican incumbent the Democrats seek to recall can do so only by falsifying his or her declaration of candidacy.
The fake candidates are committing felony election fraud, according to Levinson, a crime punishable by up to three and half years in prison.

(82,849 posts)I don't rate the odds very high of a Republican in Wisconsin being held accountable, but filing a complaint against them at the very least shows that people are onto them. The results are not guaranteed, and indeed are out of one's hands, but the filing of a complaint is within one's control.

You'd really have to find evidence that they are claiming to be republicans while simulataneously running as democrats.
I'm not sure at all that'd be so easy.
It would require an extensive investigation into personal and party records. Such investigations require money,
as well as cooperating attorneys general, and courts. I'm not sure the jurisdictions with the fakes have those
sorts of assets. I'm doubtful the state under republican control would carry out such an investigation.

(9,124 posts)One candidate received an in-kind contribution of over $5,200 for a phone bank from the St. Croix County Republican Party and five of the "fake" candidates only source of campaign funds was the Republican Party of Wisconsin, and their only expenditure was to the Republican Party for printing and postage. Three letters authorized and paid for by fake candidates say: "Please help maintain our Republican legislative majority today! We can't stress enough how important it is to have (CANDIDATE NAME) on the ballot today to combat the shady maneuvers of Madison liberals and their out-of-state allies."
