Victim in loud music shooting case was in defensive posture, expert testifies

Source: Reuters

The trajectory of the bullets that killed an unarmed teen in a gas station dispute over loud rap music indicates that the victim could not have been in an aggressive pose, a forensic expert testified on Monday in a racially charged north Florida murder trial.

Michael Dunn, 47, a white software engineer, is being retried for first-degree murder in the death of 17-year-old Jordan Davis, who was black.

Dunn fired 10 rounds at an SUV carrying Davis and his three friends at a Jacksonville gas station in November 2012. Prosecutors say Dunn over-reacted after Davis insulted him for asking to turn the music down.

Dunn’s lawyers say he acted in self-defense because of a “perceived threat” that his life was in danger, alleging that Davis was getting out of the car in attack mode when the shots were fired.

And while on their way, they can stop by ferguson, mo and pick up wilson and all the rest wearing his bracelet and sending him money and they can all live happily ever after, riding into the sunset on bundy ranch..

Not that I think that's a solution, not that I think we should, but it does have appeal.

Not sure how much more I can take! I'm really at the point that I have days I wish I never woke up! No, not going to walk out into the Gulf of Mexico, but sure seems inviting from time to time.

I hardly know what to say anymore, this country has really gone off into another place I don't recognize! What have we become???

"Yeah, I know how the defendant felt. I'm sick and tired of pulling into a gas station and hearing some asshole blasting
their (Black) Crap music so loud, I can hardly think. Maybe this will send a message to those *$%$#."

The other people on the jury will see it for what is was. (Murder)

Final result=Hung Jury.

Defensive posture huh? Folding ones arms is also a defensive posture ...according to my C security guard class instructor.

And as a partially deaf man in Seattle learned a few years ago, turning to see who is yelling "hey, hey, drop the knife" is also an aggressive movement. At least the guy in the case you quote said "what have I done" rather than simple shrugging it off.

Hand up, threat. Turning around, threat. Existence, threat.

That just freaking pisses me off! Jordan Davis was a HUMAN BEING who had a NAME! Even if you steal/borrow/appropriate a story from another source, is it possible to change the header of your post? "Loud music case/trial" devalues the humanity of Jordan Davis, who was seated in the BACK of the car, nowhere near the audio controls, even!

Many neighbors and others have some very negative stories they've told about him! But will this be allowed, bet NOT!

Can't post what I want this man to suffer. Against the death penalty myself, but there are "other things" that I can think of that would make him remember for the rest of his life!

Defense attorney Waffa Hanania said the angle of bullet holes on the car door indicated it could have been open when the shots were fired. Simon said she had not considered that as she had been told the cars were too close for the door to open.
