Judge hears arguments on ballot lawsuit; no timeline for decision

LINCOLN Lancaster County District Judge Lori Maret heard arguments Tuesday on a lawsuit seeking to put former Lt. Gov. Lavon Heidemanns name back on the ballot.
Mark Elworth Jr., the Libertarian candidate for governor, filed the suit Friday seeking to have Heidemann restored to the ballot as the running mate for GOP gubernatorial candidate Pete Ricketts.
His attorney, Elizabeth Eynon-Kokrda, argued that the court should order Secretary of State John Gale to make the change. She said Nebraska law does not give the Secretary of State any discretion about the Sept. 1 deadline for gubernatorial candidates to choose their running mates.
The Secretary of State has certified an erroneous ballot, she said.
