Federal court strikes down parts of Act 10

A federal judge in Madison on Friday ruled that portions of Act 10 - which removed most collective bargaining for most public employees - are unconstitutional.

Seven major unions had challenged the fact that Act 10 required absolute majority union recertification and denied voluntary union dues deductions as to general employee unions.

The court found those provisions violated equal protection and First Amendment rights, considering that the same rules did not apply to unions for public safety workers like police and firefighters, and the state could not state a rational basis for the distinction.

"So long as the State of Wisconsin continues to afford ordinary certification and dues deductions to mandatory public safety unions with sweeping bargaining rights, there is no rational basis to deny those rights to voluntary general unions with severely restricted bargaining rights," wrote U.S. District Judge William M. Conley.

2. "Parts of Act 10" meaning what exactly was stuck down

I get the recertification part is now gone as is the opting out of union dues, but what about all the other stuff Act 10 took away?

We can only hope this is the beginning of reversing a number of those egregious assaults on the rights of working men and women. I don't know the lay of the land very well but hopefully Walker will be defeated in the recall election. If not it will either harden him even more or he will back off the worst of his excesses.

Many are not thrilled with the candidates, but I will vote for ANYONE against Walker who will restore our state (and that includes collective bargaining rights). It is amazing to me how many "I Stand with Walker" signs I have seen popping up in yards (far fewer than Recall Walker signs though...by a mile). And I even saw some nut with one of those little stretchy plastic wristbands (you know like "Livestrong&quot that said "I stand with Walker". Thought I would barf.

Nonetheless, he is a cocky little prick who will not stop and feels emboldened by ALEC and his Koch Men. But we have people power. If he survives the recall as gov, I fear other right wing governors around the country will try this one on for size. We must prevail.

And they won't be able to change it now, since the Senate is now majority Dems, they no longer have the votes.

It's good to see they screwed themselves by excluding the police unions, which they did because they were afraid of them.
