Residency issues no bar to Kerrey (D-NE US) Senate bid

Democrat Bob Kerrey was not a Nebraska resident when he filed to run for U.S. Senate, but the U.S. Constitution clearly allows his name to be on the ballot, according to Nebraska Secretary of State John Gale.

Gale’s ruling may not be the last word on the subject, however. The State GOP has vowed to pursue further avenues to contest Kerrey’s candidacy, including a court challenge.

Gale’s decision Friday clearly gave the Republicans plenty of ammunition.

A Republican, Gale strongly chastized Kerrey for his “cavalier” attitude in claiming he was a Nebraska resident when he was staying at an Omaha hotel the day he registered to vote. But Gale also ruled that the U.S. Constitution trumped Nebraska’s residency laws.

Chuck Hagel lived in the Washington D.C. area when he decided to run for the U.S. Senate from Nebraska. Before him Hal Daub also lived in the Washington D.C. area before running successfully for the House. The Constitution simply says that they must be a resident on the day of the election. A court challenge will simply make the Republicans look petty and foolish. That's why the Democrats never challenged Daub or Hagel.
